<br />EXHIBIT "A" <br /> <br />SCOPE OF SERVICES AND FEE <br /> <br /> <br />CBA shall provide automated dialing and prerecorded message services to RWC for a one time <br />set fee, recurring monthly charge and per call charge as follows: <br /> <br />Phase I - Set fee <br />Phase I - Make 1 automated call to delinquent customer accounts per <br />week <br />Phase I - Monthly administration fee <br /> <br /> <br />$350.00 <br />~~-"_. <br />$1.50 per <br />call <br />$100.00 p <br />month <br /> <br />A. CBA shall provide automatic dialing for a term of six months (6 months) with an option to <br />renew for a second six month term. CBA will deliver pre-recorded messages, as defined herein, <br />to RWC for a fee to be paid monthly. <br /> <br />B. CBA shall compose and be responsible for the text of RWC pre-recorded messages, <br />and CBA shall ensure that the services it provides under this Addendum are in compliance with <br />all applicable laws, regulations, ordinances and industry standards in the use of the collections <br />calls, telephone dialing systems, pre-recorded message delivery systems, or the use of <br />telephone, internet, or other communication methods. CBA will agree to indemnify RWC from <br />damages, claims or liability arising out of the failure or alleged failure to comply with applicable <br />laws, regulations, ordinances or industry standards in the use of the collections calls, telephone <br />dialing systems, pre-recorded message delivery systems, or the use of telephone, internet, or <br />other communication methods. <br /> <br />C. CBA shall, at its sole discretion, determine how to conduct the automatic dialing and <br />delivery of pre-recorded messages. Notwithstanding the foregoing, RWC shall have discretion <br />to approve the pre-recorded messages prepared by CBA, but the approval of the pre-recorded <br />message by RWC shall in no way relieve CBA of its duty to ensure that the RWC approved pre- <br />recorded messages are compliant with all applicable laws. <br /> <br />D. For purposes of this Addendum, the term "automatic dialing and delivery of pre-recorded <br />messages" shall refer to telephone messages left for RWC customers which shall be for the <br />purpose of reminding the customer that the customer's monthly bill to City of Redwood City is <br />"past due". <br />
