City of Redwood City Redwood Shores Branch Library FEES AND TERMS Our services will be provided in accordance with the attached terms and conditions and hourly rate schedule. We estimate that the cost of our geotechnical observation and testing services will be approximately $43,510, which includes a 5% discount, based upon the hours and tests shown in Table 1. Our invoice will include a 5% discount on the attached hourly rates. Hours or tests less than or greater than those shown will proportionately reduce or increase our costs. Please note that our estimate depends a great extent on the site conditions, the diligence and efficiency of the prime and sub-contractors, and the weather. To be recognized, any dispute over charges must be claimed in writing within 30 days of the billing date. Disputes or questions about a statement shall not be cause for withholding payment for remaining portions due. Requested changes to this contract must be approved in writing before we proceed. A service charge of 1 percent per month shall be assessed on balances unpaid 30 days after the issue date of TRC Lowney' statement to compensate TRC Lowney for the cost and burden of administering the account and collecting fees owed. Additional services requested by you that are not outlined in this agreement, such as attendance at project meetings and preparation of draft reports, will be charged on a time- and-expense basis. RESPONSIBILITIES OF THE GEOTECHNICAL ENGINEER AND CONTRACTOR The presence of our field representatives will be for the purpose of providing observation and testing services. Our work will not include supervision or direction of the actual work of the contractor. The contractor should be informed that neither the presence of our field representatives nor the observation by our firm shall excuse him in any way for defects discovered in his work. It is also understood that our firm will not be responsible for job or site safety. MEANING OF "OBSERVATION" The term "observation" indicates that we will observe the work we agree to be involved with and perform tests as appropriate.
