Neither street is
currently controlled (no stop signs) at this intersection. A total of 11 residents
representing properties within a block of the subject intersection, including aU four
properties on the comers, signed the petition.

The intersection of Topaz Street and Madison Avenue has had a reasonably good
safety record. From June 2001 through the end of 2006, Police records show two
accidents at that intersection.

Although the accident history does not indicate an unusually hazardous intersection,
staff believes there are circumstances such that the Council could reasonably make a
finding that stop signs are warranted on Topaz Street at Madison Avenue. These
circumstances include:

);> It is possible that recent accidents and the many near-misses reported by
neighbors result from drivers on both streets not realizing that traffic on the cross
street does not stop, and failing. to behcwe as is their obligation under the Vehicle
Code at an uncontrolled intersection.

);> Because the traffic volume on Topaz Street is relatively low, the stop signs will
not inconvenience large numbers of drivers, and the noise consequences of the
stops will not be as noticeable as at intersections on busier streets.

);> Residents of all four comer properties at the intersection, who are most
susceptible to additional noise and emissions from vehicle braking and
acceleration with stop signs, signed the requesting petition.

)- The stop signs are not likely to cause measurable diversion of traffic to
neighboring local streets, because the volume on Topaz Street is relatively low,

Page 1 of2
