The Client shall render decisions as expeditiously as necessary for orderly progress of the Architect's work. B. It shall be the Client's responsibility to provide reports, surveys and any other information as required. C. Unless otherwise provided in this agreement, the Architect and Architect's consultants shall have no responsibility for the discovery, presence, handling, removal or disposal of or exposure of persons to hazardous materials, in any form at the Project site, including but not limited to asbestos, asbestos products, polychlorinated biphenyl (PCB) or other toxic substances. It shall be the Client's responsibility to identify and mitigate any hazardous materials contained within the project site and building structure. II. Ownership and use of documents: Refer to Base Contract A. Designs and drawings produced by Anderson Brul6 Architects, Inc. in any phase of the project may not be utilized by any other architect, designer or contxactor without the expressed written consent of Anderson Bml6 Architects, Inc. B. If Anderson Bral6 Architects, Inc. for any reason does not complete all the services contemplated by this agreement, Anderson Brul6 Architects, Inc. cannot be responsible for the accuracy, completeness or workability of the contract documents prepared by Anderson Brul6 Architects, Inc. if used, changed or completed by the Client or by another party. C. The client grants permission to Anderson Brale Architects, Inc., to publish images of this project as well as submit this project for awards in publications, etc. III. Billing: A. Invoices shall be mailed on a monthly basis based on the work completed, and are due upon receipt. Interest will be charged on all accounts not paid within 30 days of receipt of invoice at a rate of 1.5% per month until paid. B. Non payment of any amount due under this proposal shall constitute a material breach. Should any payment due Anderson Brul6 Architects, Inc. remain due and unpaid for a period of 45 days, Anderson Bml6 Architects, Inc. may, upon five days' written notice to Client, stop all work required under this proposal. Anderson Bml6 Architects, Inc. shall not be held liable for any damages or costs which may occur as a result of such stopping of work. C. This proposed fee does not include reimbursable expenses. Please see below for reimbursable expense information. D. Any additional services not listed within the contracted scope of work shall be charged on an hourly basis or as an additional fixed fee upon written authorization of the Client.
