Terms and Conditions <br /> Proposal for Professional Services <br /> Redwood City B. ranch Library in Redwood Shores <br /> Page 11 afl4 <br /> September 13, 2002 <br /> <br />1. Client Responsibilities: <br /> A. The Client shall render decisions as expeditiously as necessary for orderly progress of the Architect's <br /> work. <br /> <br /> B. It shall be the Client's responsibility to provide reports, surveys and any other information as required. <br /> <br /> C. Unless otherwise provided in this agreement, the Architect and Architect's consultants shall have no <br /> responsibility for the discovery, presence, handling, removal or disposal of or exposure of persons to <br /> hazardous materials, in any form at the Project site, including but not limited to asbestos, asbestos <br /> products, polychlorinated biphenyl (PCB) or other toxic substances. It shall be the Client's responsibility <br /> to identify and mitigate any hazardous materials contained within the project site and building structure. <br />II. Ownership and use of documents: Refer to Base Contract <br /> A. Designs and drawings produced by Anderson Brul6 Architects, Inc. in any phase of the project may not <br /> be utilized by any other architect, designer or contxactor without the expressed written consent of <br /> Anderson Bml6 Architects, Inc. <br /> <br /> B. If Anderson Bral6 Architects, Inc. for any reason does not complete all the services contemplated by this <br /> agreement, Anderson Brul6 Architects, Inc. cannot be responsible for the accuracy, completeness or <br /> workability of the contract documents prepared by Anderson Brul6 Architects, Inc. if used, changed or <br /> completed by the Client or by another party. <br /> C. The client grants permission to Anderson Brale Architects, Inc., to publish images of this project as well <br /> as submit this project for awards in publications, etc. <br />III. Billing: <br /> <br /> A. Invoices shall be mailed on a monthly basis based on the work completed, and are due upon receipt. <br /> Interest will be charged on all accounts not paid within 30 days of receipt of invoice at a rate of 1.5% per <br /> month until paid. <br /> <br /> B. Non payment of any amount due under this proposal shall constitute a material breach. Should any <br /> payment due Anderson Brul6 Architects, Inc. remain due and unpaid for a period of 45 days, Anderson <br /> Bml6 Architects, Inc. may, upon five days' written notice to Client, stop all work required under this <br /> proposal. Anderson Bml6 Architects, Inc. shall not be held liable for any damages or costs which may <br /> occur as a result of such stopping of work. <br /> <br /> C. This proposed fee does not include reimbursable expenses. Please see below for reimbursable expense <br /> information. <br /> <br /> D. Any additional services not listed within the contracted scope of work shall be charged on an hourly basis <br /> or as an additional fixed fee upon written authorization of the Client. Services rendered on an hourly <br /> basis will be charged as follows. <br /> <br /> <br />
