FURTHER A~REEMENT. In the performance of this Agreement, Motorola <br />agrees (1) to comply with all applicable federal and state statutes, executive orders or <br />implementing rules or regulations, and (2) not to discriminate against any employees, <br />deny benefits to any employees, or exclude any employees from participation in this <br />Agreement on the basis of race, color, religion, sex, national origin/ancestry/citizenship, <br />age, marital status, disability, sexual orientation, veteran and/or any other protected class <br />status, as defined by and in violation of such laws, orders, rules or regulations. <br /> <br />Motorola acknowledges that its compliance with this provision is an important objective <br />of Customer. Therefore, for each violation of this prox ~sion with respect to any Motorola <br />employee living in San Mateo County or working in San Marco County in furtherance of <br />the performance of this Agreement, Motorola shall pay to Customer liquidated damages <br />in the amount of $2,500 per violation.
