This prohibition shall not apply to the tables and chairs used on the Premises as long as the <br /> <br />tables and chairs, when not in use, are not stacked outdoors. <br /> <br />6.5 Licensor makes no warranty or representation of any kind concerning the <br /> <br />condition of the Premises, or the fitness of the Premises for the use intended by Licensee. and hereby <br /> <br />disclaims any personal knowledge with respect thereto, it being expressly understood by the parties that <br /> <br />Licensee has personally inspected the Premises, knows its condition, finds it fit for Licensee's intended <br /> <br />use, accepts it as is and has ascertained that it can be used for the limited purposes specified in Section <br /> <br />5.1. <br /> <br />7. LICENSEE IMPROVEMENTS <br /> <br />7.1 In consideration of the approval of this License agreement, Licensee agrees to <br /> <br />clean up the rear area of their property and build an approved outside storage facility. Licensee must <br /> <br />remove the existing container referenced in the Licensee's Planning Use Permit and replace that <br /> <br />container with a properly built, aesthetically pleasing storage facility. The storage facility area must be <br />properly screened. The storage facility improvement plans and specifications must be reviewed and <br /> <br />approved by the Licensor. <br /> <br />7.2 In consideration of the approval of this License agreement, Licensee agrees to <br /> <br />designate a loading zone for deliveries at the rear of the property as specified in the Planning Use Permit. <br /> <br />7.3 Licensor shall make available to Licensee any engineering reports in its <br /> <br />possession regarding the Premises, including any site plans and elevations. and a parcel map. <br /> <br />7.4 Licensee at his own expense will work with a qualified architect and general <br /> <br />contractor to complete any needed improvements to the Premises in accordance with plans and <br /> <br />specifications approved by Licensee and Licensor ("Plans and Specifications") using only licensed <br /> <br />contractors and in accordance with Building Codes and other government laws and regulations, including, <br /> <br />without limitation, the American Disabilities Act ("ADA"). <br /> <br />7.5 Licensee shall have the right to measure the Premises to ensure size accuracy, <br /> <br />The license provisions shall be adjusted according to such measurements prior to the execution of the <br /> <br />License. <br /> <br />ATTY/AGR12007,002 <br />012407 <br /> <br />6 <br />
