<br />6.1A <br />Page 1 <br /> <br />REPORT <br /> <br />To the Honorable M'ayor and City Council <br />And the Redevelopment Agency Board <br />From the Oi, M,;inaer and tile Executive Director <br /> <br />February 5, 2007 <br /> <br />Subject <br />License Agreement between the Redevelopment Agency and Tarboosh Restaurant. <br /> <br />Recommendation <br />By motion, approve the License Agreement and authorize the Redevelopment Agency <br />Executive Director to make any "non-sustantive" modifications as necessary for <br />execution. <br /> <br />Background <br />On October 24, 2005 the Redevelopment Agency Board ("RDA") approved an Outlease <br />Agreement with the United States Postal Service ("USPS") for the open space located <br />between the downtown post office and the building currently occupied by the Tarboosh <br />Restaurant ("Tarboosh"). This innovative partnership was undertaken with the intent of <br />furthering the City's policy of ". . . creating comfortable, enjoyable and aesthetically <br />pleasing public spaces. . . ," and upgrading a green space that has historically been <br />underutilized, flooded during the rainy season and poorly maintained. The Outlease <br />between the RDA and the USPS enables the RDA to demolish some of the existing <br />improvements and to construct new improvements known as "The Paseo" designed by <br />Ron Benoit Associates, landscape architects. The contract for the construction of the <br />improvements was awarded by the RDA on November 30, 2006 and work has <br />commenced with completion scheduled in April 2007. <br /> <br />The final provision of the Outlease to be implemented is the License Agreement with <br />Tarboosh for approximately 2,000 square feet of The Paseo adjacent to the restaurant. <br />Tarboosh in turn will build improvements for outdoor dining on this portion of the site <br />(see Site Plan, Exhibit B of License Agreement, Attachment 1). The License <br />Agreement includes provisions requiring the restaurant to pay for the improvements to <br />the dining area and pay for maintenance of portions of The Paseo as well as the dining <br />area, More importantly, it is contingent upon compliance with all entitlements and <br />permits required for operation of the restaurant and outdoor dining. A more detailed <br />description of the terms of the License Agreement follows. <br /> <br />Terms of License Aareement: All provisions of the License Agreement are subject to <br />the agreement between the RDA and USPS. Specifically, the key provisions include: <br /> <br />1.
