DES:d4k 06/09/98 (078/32) <br /> <br /> WHEREAS, the proposed assessment is imposed exclusively to <br />finance the maintenance and operation expenses for sewers, water, <br />flood control and drainage systems and is not proposed to be <br />increased over the amount of assessment in effect prior to <br />November 6, 1996, the effective date of Article XIII D of the <br />California Constitution; therefore, the procedures and approval <br />process of Section 4 of that Article are not applicable to the <br />herein proceeding; and <br /> <br /> WHEREAS, pursuant to Resolution No. 13350 entitled, <br />"Resolution of Intention to Order the Levy of Benefit Assessments <br />Using the Alternative Method, Approving City Engineer's Report, <br />and Providing Notice of Hearing Thereon - Seaport Centre <br />Maintenance District (Fiscal Years 1998-99 and 1999-2000)", <br />adopted June 1, 1998, this Council approved the City Engineer's <br />Report (the "Report") required to be prepared pursuant to said <br />Ordinance No. 1895 setting forth the amounts to be provided in <br />the budget for maintenance and operation, a description of each <br />lot or parcel of property in the District, by a legal <br />description, Assessor's Parcel Number or other description <br />sufficient to identify the same, and the amount of assessment to <br />be levied for the fiscal years 1998-1999 and 1999-2000 against <br />each lot or parcel of property; and <br /> <br /> WHEREAS, notice of hearing on any and all protests in <br />relation to the Report was given by causing a notice of hearing <br />to be duly posted, published and mailed in the time, form and <br />manner provided by said Ordinance No. 1895, all as more <br /> <br /> 13373 <br /> 2 <br /> <br /> <br />
