underlying fee of the property upon which the roadway easement is to be acquired and title confirmed <br />was offered just compensation for the mai property interest hereinafter described; and, <br /> <br /> WHEREAS, the public interest and necessity require the acquisition and confirmation of title of <br />the roadway easement from the real property hereinafter described in Exhibit "A" for a public use, <br />namely, public street purposes, including the reconstruction of the roadway and continued pubic street <br />use; and, <br /> <br /> WHEREAS, the City is authorized to exercise the power of eminent domain for the purpose of <br />taking such property by virtue of Government Code Sections 37350.5 et. seq. and 40404, and by <br />Code of Civil Procedure Sections 1230.020, 1240.010, 1240.020, 1240.110, 1240.120, 1240.130, <br />1240.510 and 1240.610; and, <br /> <br /> NOW, THEREFORE, IT IS FOUND, DETERMINED AND RESOLVED BY THE CITY OF <br />REDWOOD CITY, as follows: <br /> <br /> 1. The real property and real property interest to be acquired is an easement, and is <br /> <br />described in Exhibit "A", attached hereto and incorporated by reference herein. <br /> <br /> 2. The public interest and necessity require the acquisition, construction and operation of <br /> <br />the Project, a public use, and that an easement be acquired and/or confirmed over the real property, all <br />as described in Exhibit "A" be taken for such public use. <br /> <br /> 3. The public use for which the easement over real property described in Exhibit "A" will <br /> <br />be acquired and to which it will be put is for public street purposes, including the reconstruction of the <br />roadway and continued pubic street usc. <br /> <br /> 4. The easement over real property described in this Resolution is necessary for the <br />Project. <br /> <br /> 5. The public interest and necessity require the acquisition of the real property interest <br /> <br />described in Exhibit "A", and the taking of said real property interest is necessary for the construction, <br />completion and implementation of the Project, and it is hereby directed that an easement over the real <br />property described in Exhibit "A" be acquired by the City by eminent domain proceedings as <br />hereinafter set forth. <br /> <br /> (page 2 of 4) 13312 <br /> <br /> <br />
