6. The proposed Project is planned and located in the manner that will be most compatible <br /> <br />with the greatest public good and the least private injury, namely to reconstruct that portion of Bair <br /> <br />Island Road to Pete' s Harbor currently used by the public for street purposes as described in Exhibit <br /> <br /> 7. The City has complied with the Califomia Environmental Quality Act, found in Public <br /> <br />Resources Code Sections 21000, et. seq. and the State CEQA Guidelines adopted by the Secretary of <br />Resources. <br /> <br /> 8. The offer required by Section 7267.2 of the Government Code has been made to the <br /> <br />owner of record. <br /> <br /> 9. The staff report of the City is incorporated herein by reference in support of the above <br />findings. <br /> <br /> 10. The City Manager and Spex~ml Eminent Domain Counsel, the Law Offices of Herman <br />H. Fitzgerald, acting by and through Christine C. Fitzgerald and/or Herman H. Fitzgerald, are <br />authorized and directed to perform all acts necessary on behalf of the City for the acquisition of said <br />interests in real property, and to do any and all other things in connection with such proceedings as in <br />their judgment may be necessary or convenient to the successful conclusion of said proceeding or <br />proceedings, including obtaining of an Order for Immediate Possession, the preparation, filing, <br />amendment, dismissal, etc. of all pleadings and stipulations that in the opinion of Special Counsel are <br />necessary for the processing of the litigation. <br /> <br /> 11. The City Manager is hereby authorized to expend funds available to the City for the <br />acquisition of the real property and/or interests therein. <br /> <br /> 12. The City Manager is hereby individually authorized and directed to consent to and <br />accept, on behalf of the City, all deeds and grants conveying any interest in the property as <br />hereinabove described. <br /> <br /> 13. The City Manager is hereby authorized and directed to record a certified copy of this <br />Resolution in the Office of the County Recorder of the County of San Mateo. It may thereafter be <br />referred to in any acceptance by any of the officers or agents referred to herein with the same effect as <br /> <br /> (page 3 of 4) 13312 <br /> <br /> <br />
