6.1 F <br /> Page 42 <br /> (1} that the position af the grievant shall be sustained; or <br /> (2) that the position of the Potice Chief sha[t be sust�ined. <br /> 97.3.4.6 After a hearing and after both parties have had an <br /> opportunity to make written arguments, the arbitrator shail <br /> submit in writing to alt parties his findings and award. <br /> 17.3.4.7 The award of the arbitrator shatl be final and binding. <br /> 1i.3.4.8 The fees and expenses of the arbitrator shall be shared <br /> c�uatty �y t1�ie Ciiy ar7c! th�Hssociation. <br /> Al[ other expenses shall be borne by the party incurrin� <br /> them, and neither party shatl be responsible for the <br /> expense of witnesses catted by the other. Either party may <br /> request a certified court reporter to record the entire <br /> arbitration hearing. The cost of the services of such court <br /> reporter shall be shared equally by the parties. <br /> 17.3.4.9 By filing a grievance and processing it beyond Level III, tF�e <br /> grievant expressty waives any right to statutory remedies or <br /> to the exercise o� any Eega! process other than as provided <br /> by this grievance/arbitration procedure. The processing of <br /> a grievance beyond Level lil shall constitute an express <br /> efection on the part of the grievant that the <br /> grievance/arbitration procedure is the-chosen forum-for <br /> resolving the issues contained in the grievance, and that <br /> tf�e gri�v�nt wili not resort to any oti�er forum or <br /> procedure for resolufiion or review of the issues. The <br /> parties do not intend by the provisions of this paragraph to <br /> prec[ude the enforcement of any arbitration award in any <br /> caurt of competent jurisdiction. <br /> SECTEON 18. OUTSIDE EMPLOYMENT <br /> 18.1 A unit member shall nat enga�e in any emptoyment, activity or enterprise for <br /> compensation which is in�onsistent, incompatibte, in conftict with, or inimicat <br /> to his/her duties as an employee of the City, or with the duties, functions, or <br /> responsibilit9es of the City. <br /> 18.2 A unit member shall secure written appravat from the Chief of Police prior to <br /> engaging in any employment, activity, or enterprise for compensation which <br /> coutd be judged to be inconsistent with, incompatible to, or in conflict with <br /> the unit member's duties as an employee of the City.
