consecutive months of unemployment, one (1) year on a rehire list, or the <br /> refusal by an employee on the rehire list to report to a rehire assignment made <br /> by the City. <br /> <br />16.4 Benefits During Layoff <br /> <br /> During the one (1) year on a rehire list, the employee shall not accrue any <br /> benefits, including, but not limited to, vacation, sick leave, holidays, medical, <br /> dental, life insurance and uniform allowance. Any employee reemployed from <br /> the rehire list shall retain all vacation and sick leave accruals that the employee <br /> did not receive compensation for at the time of layoff. <br /> <br />16.5 Length of Service <br /> <br /> The department shall keep an up-to-date length of service list of all employees <br /> covered by this MOU, and post the length of service list in a conspicuous place. <br /> This provision is for the convenience of the parties and in case of any disputes <br /> concerning the accuracy of the posted list, the grievance procedure may be <br /> utilized. <br /> <br /> SECTION 17 - RETIREMENT <br /> <br />17.1 Retirement Plan <br /> <br /> Retirement benefits for employees shall be those established by the Public <br /> Employees' Retirement System (PEP, S) for Local Safety Members Two Percent <br /> (2%) at Age Fifty (50) Formula. <br /> <br /> Effective .]uly 1, 2003 the City will amend the PERS contract to change to Three <br /> Percent (3%) at Age Fifty (50) Formula. <br /> <br />17.2 Optional Provisions Added <br /> <br /> Optional Public Agency Provisions under the Public Employees' Retirement <br /> System shall also be provided as follows: <br /> <br /> 1. Effective April 1, 1969, 1959 Survivor Allowance as set forth in Article 6 of <br /> Chapter 9 of the Public Employees' Retirement Law (commencing with <br /> Section 21380 of the Government Code), which will provide the third tier <br /> of benefits. <br /> <br /> 2. Effective March 16, 1989, one (1) year highest compensation as <br /> authorized by Section 20024.2 of the Government Code. <br /> <br /> 3. Effective .~uly 1, 2003, Pre-Retirement Optional Settlement 2 Death <br /> Benefits as authorized by Section 21548. <br /> <br /> 2'7 <br /> <br /> <br />
