<br />of a non-monetary obligation after five (5) days written notice from Licensor, except that, if the non- <br /> <br />monetary obligation is such that it takes longer than thirty (30) days to cure, Licensee shall not be <br /> <br />deemed in default if Licensee commences the cure within such thirty (30) day period and completes the <br /> <br />cure within fifteen (15) days thereafter. <br /> <br />14. HAZARDOUS MATERIALS <br /> <br />14.1 Prior to the User Fee Commencement Date, Licensee shall have the right to <br /> <br />make any tests and/or studies Licensee deems necessary with respect to any hazardous materials in, on <br /> <br />or about the Premises. If found, Licensee shall meet with the Licensor to determine if such hazardous <br /> <br />material poses a health and safety issue that may require its removal or remediation. Licensor shall <br /> <br />provide Licensee with copies of any hazardous material tests it or any other party has conducted on the <br /> <br />Premises or Building, in its possession. Licensor shall not have any obligation to remove or remediate <br /> <br />hazardous materials and shall retain the right to immediately terminate this license if continued use of the <br /> <br />Premises by Licensee requires such removal or remediation. Licensor shall not be responsible for any <br /> <br />costs incurred by Licensee prior to such termination or as the result of such termination. <br /> <br />14.2 Compliance with Laws. Licensee shall not cause or permit any Hazardous <br /> <br />Material (as defined below) to be brought upon, kept or used in or about the Premises by Licensee, its <br /> <br />agents, employees, contractors or invitees. <br /> <br />14.3 Termination of License. Licensor shall have the right to terminate the License in <br /> <br />Licensor's sole and absolute discretion in the event that (i) any anticipated use of the Premises by <br /> <br />Licensee involves the generation or storage, use, treatment, disposal or release of Hazardous Material in <br /> <br />a manner or for a purpose prohibited or regulated by any governmental agency, authority or Hazardous <br /> <br />Materials Laws; (ii) Licensee has been required by any lender or governmental authority to take remedial <br /> <br />action in connection with Hazardous Material contaminating the Premises, if the contamination resulted <br /> <br />from Licensee's action or use of the Premises; or (iii) Licensee is subject to an enforcement order issued <br /> <br />by any governmental authority in connection with the release, use, disposal or storage of a Hazardous <br /> <br />Material on the Premises. <br /> <br />14.4 Assiqnment.
