This Council hereby declares and determines that the <br /> <br /> <br />Subject Property is necessary for the public purpose of <br /> <br /> <br />acquiring, constructing, and maintaining public roads, storm <br /> <br />drains, sanitary sewers, water facilities, and other public <br /> <br />utilities or facilities and appurtenances thereto in connection <br /> <br />with the widening and improving of Seaport Boulevard in the City <br /> <br /> <br />of Redwood City. <br /> <br /> <br />2. This City is authorized to acquire the Subject Property <br /> <br /> <br />by eminent domain pursuant to the provisions of Section 3 of the <br /> <br />Charter of the City of Redwood City and Sections 37353 and 40404 <br /> <br /> <br />of the Government Code. <br /> <br /> <br />3. This Council hereby declares that it has found and <br /> <br /> <br />determined each of the following: <br /> <br />(i) The public interest and necessity required the proposed <br /> <br /> <br />project; <br /> <br />(ii) The proposed project is planned or located in the <br /> <br />manner that will be most compatible with greatest <br /> <br /> <br />public good and the least private injury; <br /> <br />(iii) The Subject Property is necessary for the proposed <br /> <br /> <br />project; and <br /> <br />(iv) The offer required by Section 7267.2 of the Government <br /> <br /> <br />Code has been made to the owner or owners of record of <br /> <br />the Subject Property. <br /> <br /> <br />4. The City Attorney and/or his designee is hereby <br /> <br />authorized <br /> <br />to <br /> <br />commence <br /> <br />an <br /> <br />action <br /> <br />in <br /> <br />eminent <br /> <br />domain <br /> <br />for <br /> <br />2 <br /> <br />9888 <br />
