<br />NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED as <br />follows: <br /> <br />1. That the owners of more than one-half of the area of the <br />property in the Seaport Centre Maintenance District in said City <br />subject to benefit assessment to pay said costs and expenses of <br />maintenance and operation did not, at or prior to the time fixed for <br />said hearing, or during said hearing, file written protests against the <br />formation of the maintenance district, the extent thereof, the <br />application of said alternative method for the levy of said benefit <br />assessment pursuant to said Ordinance No. 1895, the method and formula <br />fixed for the levy of benefit assessments, or other matters pertaining <br />to any of the above. <br /> <br />2. That no protests of any kind, written or oral, were filed or <br />made at said hearing. 3. That a maintenance district is hereby <br />ordered formed to be entitled and known as, "Seaport Centre Maintenance <br />District", and that the costs and expenses of maintaining and operating <br />the following described local public improvements, including the cost <br />of necessary. repairs, replacements, fuel, power, electrical current, <br />care, supervision and any and all other items necessary for the proper <br />maintenance and operation thereof, shall be assessed either partly or <br />wholly upon the District herein described which District said Council <br />hereby determines will be benefited bv the maintenance and operation of <br />the local public improvements proposed to be maintained; the amounts so <br />assessed are to be collected in the same manner and by the same <br />officers as taxes for City purposes are collected. <br /> <br />The local public improvements to be operated and maintained <br />consist of all of the public improvements and appurtenant facilities in <br />said District which are located within public easements but not <br />including those public improvements and appurtenances which are <br />located in public streets or in streets dedicated to the public, <br />described as follows: <br /> <br />(1. ) Levees. Any and all levees for the protection of the <br />Seaport Centre project from inundation, any and all <br />retaining walls, and any and all outboard rock slope <br />protection faci I i ties necessary for erosion control <br />together with any and all appurtenances to any of the <br />above now existing or hereafter to be constructed in <br />or for said Seaport Centre project. <br /> <br />(2.) Storm Drain System Improvements. Anv and all surface <br />and subsurface storm drainage facilities, including, <br />but not limited to, storm drain pump stations, storm <br />drain mains,manholes with manhole frames and covers, <br />and inlets and catch basins together with any and all <br />appurtenances to any of the above now existing or <br />hereafter to be constructed in or for said Seaport <br />Centre project. <br /> <br />-2- <br /> <br />9859 <br />
