<br />(3.) Water Facilities. Any and all water facilities, <br />including--:-but not limited to, water mains, valves, <br />tees, hydrants, services, meters and meter boxes, <br />together wi th any and all appurtenances thereto now <br />existing or hereafter to be constructed in and for <br />said Seaport Centre project. <br /> <br />(4.) Sanitary Sewer Facilities. Anv and all sanitarv <br />sewer facilities, including, but not limited to, <br />sanitary sewer mains, manholes with manhole frames <br />and covers, cleanouts and laterals together with any <br />and all appurtenances thereto now existing or <br />hereafter to be constructed in and for said Seaport <br />Centre Droj ect. <br /> <br />4. That the costs and expenses of maintaining and operating the <br />local public improvements within said maintenance district shall be <br />raised by the levy of special benefit assessments in accordance with <br />and pursuant to the provisions contained in said Ordinance No. 1895 for <br />t h e- a I t ern a t i v e method for the levy of be n e f it assessments in <br />maintenance districts in this City, which assessments shall be assessed <br />annually either partly or wholly upon the several lots and parcels of <br />property within said maintenance district benefited thereby bv <br />apportioning said costs and expenses according to benefit among the <br />several lots or parcels of property within said maintenance district in <br />accordance with the following formula: <br /> <br />The entire cost of annual operation, maintenance, <br />replacements, or betterments is to be levied against and be <br />borne by Assessment Parcels one (1) through seventeen (17), <br />inclusive, as shown on that certain maD entitled "Proposed <br />Boundarv Seaport Centre Maintenance District", filed in the <br />office of the City Clerk on January 24, 1985, on the basis <br />of the area that each Assessment Parcel bears to the total <br />acreage of all Assessment Parcels. The area of each <br />Assessment Parcel and the total acreage of all Assessment <br />Parcels shall not include any area which represents lands <br />owned in fee simple bv a publ ic corporation or any publ ic <br />streets in use or to be used in the performance of a publ ic <br />function. <br /> <br />5. That said formula for the apportionment of benefits in said <br />annual assessment levies be, and it is hereby, finally approved, <br />confirmed and adopted by this Council for said purpose. <br /> <br />6. That said special benefit assessments shall be levied and <br />collected annually upon the last equalized secured and utility tax <br />rolls upon which ad valorem property taxes are collected. Thev shall <br />be in addition to all other ad valorem property taxes levied, and shall <br />be collected together with, and not separate therefrom, and enforced in <br />the same manner and by the same persons and at the same time and with <br />the same penalties and interest as are said ad valorem propertv taxes. <br /> <br />-3- <br /> <br />9859 <br />
