(3.) Water Facilities. Any and all water facilities, including--:-but not limited to, water mains, valves, tees, hydrants, services, meters and meter boxes, together wi th any and all appurtenances thereto now existing or hereafter to be constructed in and for said Seaport Centre project. (4.) Sanitary Sewer Facilities. Anv and all sanitarv sewer facilities, including, but not limited to, sanitary sewer mains, manholes with manhole frames and covers, cleanouts and laterals together with any and all appurtenances thereto now existing or hereafter to be constructed in and for said Seaport Centre Droj ect. 4. That the costs and expenses of maintaining and operating the local public improvements within said maintenance district shall be raised by the levy of special benefit assessments in accordance with and pursuant to the provisions contained in said Ordinance No. 1895 for t h e- a I t ern a t i v e method for the levy of be n e f it assessments in maintenance districts in this City, which assessments shall be assessed annually either partly or wholly upon the several lots and parcels of property within said maintenance district benefited thereby bv apportioning said costs and expenses according to benefit among the several lots or parcels of property within said maintenance district in accordance with the following formula: The entire cost of annual operation, maintenance, replacements, or betterments is to be levied against and be borne by Assessment Parcels one (1) through seventeen (17), inclusive, as shown on that certain maD entitled "Proposed Boundarv Seaport Centre Maintenance District", filed in the office of the City Clerk on January 24, 1985, on the basis of the area that each Assessment Parcel bears to the total acreage of all Assessment Parcels. The area of each Assessment Parcel and the total acreage of all Assessment Parcels shall not include any area which represents lands owned in fee simple bv a publ ic corporation or any publ ic streets in use or to be used in the performance of a publ ic function. 5. That said formula for the apportionment of benefits in said annual assessment levies be, and it is hereby, finally approved, confirmed and adopted by this Council for said purpose. 6. That said special benefit assessments shall be levied and collected annually upon the last equalized secured and utility tax rolls upon which ad valorem property taxes are collected. Thev shall be in addition to all other ad valorem property taxes levied, and shall be collected together with, and not separate therefrom, and enforced in the same manner and by the same persons and at the same time and with the same penalties and interest as are said ad valorem propertv taxes. -3- 9859
