(b) In order to approve or recommend approval of a PC permit, the Planning Director or <br /> designee must find that the proposal implements the adopted Precise Plan and that <br /> the establishment, maintenance or operation of the use or uses applied for will not, <br /> under the circumstances of the particular case, be detrimental to the health, safety, <br /> peace, morals or general welfare of persons residing or working in the neighborhood <br /> of said proposed use, or be detrimental or injurious to property and improvements in <br /> the neighborhood, or to the general welfare of the City. <br />(c) The Planning Director or designee may impose or recommend such conditions in <br /> connection with the PC permit as he/she deems necessary to fulfill the purpose of <br /> this Article. <br />(d) When authorized to do so by a Precise Plan, the Planning Director or designee may <br /> issue a PC permit. In addition to the minimum standards set forth in paragraph (b) <br /> of this section, any Precise Plan making such authorization will contain reasonable <br /> and adequate standards for the guidance of the Planning Director or designee in <br /> issuing such permits. <br /> <br />52.11 Planned Community Permits, Planning Commission Public Hearing <br />In those instances where the Precise Plan specifies that the particular application for a <br />PC permit will be heard by the Planning Commission, the Planning Director or designee <br />will forward a report to the Planning Commission for consideration. <br /> <br />(a) Upon receipt of the report of the Planning Director or designee, or upon the <br /> expiration of ninety (90) days from the filing of the complete application for such <br /> permit, the Planning Commission will set the matter for a public hearing. Notice of <br /> such public hearing will be given in the same manner as provided in section 52.10. <br />(b) The failure of any property owner to receive said notice will not invalidate the <br /> proceedings. <br /> <br />52.12 Planned Community Permits, Planning Commission Action <br />(a) The Planning Commission will render its decision on the PC permit within thirty (30) <br /> days after the conclusion of such public hearing. In order to approve a PC permit, <br /> the Planning Commission must find that the establishment, maintenance or <br /> operation of the use or uses applied for will not, under the circumstances of the <br /> particular case, be detrimental to the health, safety, peace, morals or general <br /> welfare of persons residing or working in the neighborhood of said proposed use, or <br /> be detrimental or injurious to property and improvements in the neighborhood, or to <br /> the general welfare of the City. <br />(b) The Planning Commission may designate such conditions in the PC permit as it <br /> deems necessary or appropriate to secure the purposes of this Ordinance and may <br /> require guarantees and evidence that such conditions are being or will be complied <br /> with. <br /> <br />52.13 Planned Community Permits, Failure to Act <br />A PC permit will expire after one year if the applicant has not applied for and been <br />issued a building permit for the particular project and has initiated actual construction as <br /> <br />F :Atty/Ord/Ord. 162 <br />092502 <br /> <br /> <br />
