PERS and notify the member thereof and of the member's right to <br /> appeal said determination. <br /> C. If the City determines that the member is incapacitated, and that <br /> <br /> the cause is nonindustrial, but the member contends that the cause <br /> of disability is industrial, the member may petition the Workers' <br /> Compensation Appeals Board ("WCAB") for a Finding of Fact <br /> determining causation. The determination by the WCAB of the <br /> cause of incapacity (industrial or nonindustrial) shall be certified by <br /> the City to PERS, with notification thereof to the member, upon <br /> receipt of said WCAB determination by the City. <br /> <br /> D. If the City determines that the member is not incapacitated, the City <br /> shall so notify PERS and shall notify member thereof and of the <br /> member's right to appeal said determination. <br /> <br /> E. Notification to the member of the City's determination and the <br /> member's right to appeal as hereinabove provided shall be in <br /> writing and given by personal delivery or by depositing said notice <br /> with the U.S. Postal Service, first class postage prepaid (return <br /> receipt requested).
