F. If no request for a hearing is filed within the aforesaid thirty (30) day <br /> period, the initial determination shall become final upon expiration <br /> of said thirty (30) day period. <br /> <br />2. If the member requests a hearing, the hearing shall be held in <br />conformance with the Administrative Procedure Act (Gov. Code § 11500, et <br />seq.). When the member requests a hearing, the City shall notify PERS. The <br />City shall also notify the California Office of Administrative Hearings and request <br />a hearing date and a prehearing conference with an Administrative Law Judge. <br />The member shall be informed that the hearing will be held at the time and place <br />designated by the Office of Administrative Hearings, which shall set a hearing <br />date and pre-hearing conference. <br /> <br /> 3. The following procedures shall govern the hearing and subsequent <br />acts: <br /> <br /> A. The hearing shall be conducted before the City Manager or his or her <br />designee with the Administrative Law Judge acting as the presiding officer. An <br />administrative record of the hearing shall be prepared pursuant to the <br />Administrative Procedure Act. All testimony shall be recorded by a Certified <br />Shorthand Reporter. <br /> <br /> B. Following the hearing, a written decision and findings of fact shall be <br />made by the City Manager or his or her designee. The decision and findings <br />shall be served on the member by depositing the same with the U. S.
