Service, first class postage prepaid, return receipt requested, with a copy thereof <br />to PERS. <br /> <br /> C. If the member is found to be incapacitated, the City shall so certify to <br />PERS. If the member is found not to be incapacitated, or is found to be <br />incapacitated but the member contends to the contrary, the member may seek <br />judicial review of said finding by filing a petition for writ of mandate in the <br />Superior Court of San Mateo County within thirty (30) days of the date of <br />notification of said finding. Said notification shall advise the member of his or her <br />right to seek such review and the time limitation thereon. <br /> <br /> D.
