7A <br />Page 113 <br />All of the above amendments and other changes described in the attachments have <br />been evaluated by staff and the EIR authors, and the changes do not require <br />recirculation of the Draft EIR. The amendments do not make substantial changes to <br />the project that would produce any new significant environmental impacts, nor will <br />the amendments result in any substantial increase in the severity of an <br />environmental impact that would necessitate adoption of additional mitigation <br />measures to reduce the impact to a level of insignificance. Lastly, the amendments <br />do not make changes to the project that would require major revisions of the <br />environmental impact report. <br />PLANNING ENTITI_E[MENTS <br />The Downtown Precise Plan will require several planning entitlements. If the <br />Planning Commission wishes to recommend approval of the Downtown Precise Plan <br />to the City Council, then the Planning Commission must certify the EIR and then <br />recommend approval of o±her entitlements ('sn addition any recommended revisions <br />to the Draft DPP text). The specific entitlements are listed below: <br />1. Certification of the Environment Impact Report. The Planning Commission <br />shall certify that: <br />^ The Final EIR has been completed in compliance with CEQA. <br />^ The Final EIR was presented to the decision-making body {Planning <br />Commission) of the lead agency, and the decision-making body reviewed <br />and considered the information contained in the Final EIR prior to <br />approving the project. <br />• The Final EIR reflects the lead agency's independent judgment and <br />analysis. <br />^ That certification of the EIR may be appealed to the City Council within <br />seven (7) days of the final decision or determination of the Planning <br />Commission. <br />2. Adoption of a Resolution of Intention to Amend the General Plan. According <br />to Section 41.2 of the Zoning Ordinance, amendments to the General Plan <br />may be initiated by a resolution of intention by the Planning Commission. <br />This needs to be done prior to the Planning Commission making a <br />recommendation to the City Council. <br />3. General Plan Land Use Map Amendment. The current General Plan Land <br />Use Map shows most of the Draft Precise Plan area as being "Mixed Use <br />(Commercial and Residential}" with other parts being "Moderate and High- <br />Rise Residential Structures", "Government", uOffice Park Oriented Uses", <br />and "Multi-Story Structures for Office and Retail Uses". (These latter <br />designations do not allow residential uses}. Staff is proposing new General <br />Plan land use map designs#ions entitled "Downtown Mixed Use" and <br />"Downtown Mixed Use Expansion Blocks". These new land use <br />designations would allow all of the uses discussed in the Downtown Precise <br />Plan including residential uses throughout the entire Plan area.
