(Proposed Condominiurrc Project) <br /> I-Iot�orable May�r and Council Members: <br /> This firm represe.nts the Hampton Oaks Uwners Association, which is adjacent to the <br /> proposed project cited above. <br /> On November 28, 2006 the Planning Commission adopted a Negative Declaratiox� for the <br /> project and recoinmended to the City Council the adoption af the Precise Plan that wauld goven� <br /> the project. With the Plannin�Commission review thus complete, the Council will presumably <br /> put the project on ils agenda in the near future. <br /> I am writing to reguest that, in scheduling its consideration of this project, the Council <br /> allow adequate time for the Ha.inpton Oaks Owners, and others in tlae vicinity who oppose tl�e <br /> project as currently conceived, to prepare their critique of the Negative Declaration and other <br /> aspects of the project. <br /> The Hampton Oaks Owners have engaged a traffc engineer and a hazardous materials <br /> consultant to review thc relevant aspects of the Negative Dcclaration and to conduct their own <br /> int�estigations. To allow these consultants adequate time to}�repare for the Council ineeting, fihe <br /> I-�ampton Oaks Owners request that the Council defer consid�ration of the project unlil A}�ril <br /> zaa�. <br /> Key amoi�g the Hampton Owners' concerns is the Planning Cornmission's apparent <br /> willingness {based on the n7eeting minutes from November 2K, 200b) to rely on traffic studies <br /> after the project is built to determine just how si�nificant traftic impacts will be. Becausc this <br /> - "puts the cart before the horse," such relia�lce on future studies vioiates the California <br /> Environmental Quality Act(CEQA). [See, e.g.,.Sundstrom v.
