9A
Page 46
Honorable Mayor 1'ierce and Ciry Council
April 3, 2007
Page 5
Here, unlike Sundstrom, prior co adoption of the IS/MND, a Traffic Impact Analysis
was prepared to evaluace ehe pocential for the projecc o result in traffic impacts and, based on thar
sti.idy, the ISIMND concluded that any traffic impacts would be Iess than significant. The Ciry
thereEore correctly determined tliat no micigation was required. (See CEQA Gttidelines g
15126.4{A)(3) ["mitigacion measures are not required For effects which are not fund to be
significant"].) The Planning Commission appropriately recommended adoption of the IS/MND
given the ftnding of a less-than-significant impact. (See Publ:c ResourcCode y 21064.5,
[er►nitt'sng tle adaptioa cf rnitigared negacive deciarations where the project as mitigated wiii res«it
ii no signicant effects on the e;ivironri7enc.} Accoreingiy, rhe trairic monitoring reporr wili noi
serve as mitigation fr a potential project impact, as the Iinpacc Ana]ysis has already found thac chere
is no potenial inpacc, nor will it provide an evaluation oFpotetial impacts, as they have already
becn evaivated. 'I"rie purpose of the monitoring reporr would only be co update the Ciry on the
crrent traffic condicions in the grearer neighborhood surrotzncling the Projecc. The Planning
Canmission concurred with rhe less-thac-significant craffic impact finding when ic adopted tlie
IS/MND, and it did not caIl inco qtiescian he accurary of the Iinpact Analysis, but simply requesred
inonitring oF the project after occupancy to confirm the r.esults of the study and to fiirther assure
t(at the neighborhood's coice-ns were addressed. For these reasons, the monitoring repcrt is
appropriare.
Hazardous Materials
Coinments also were raised by the Hampton Oaks wners Association concerning
t}e preserce of soil and brouncwater contaminauon at the site due ro a major fuel spill ac a
neiglboring property in 195. The City's IS/MND contained an evaluatioii of any potertial
lazards and hazardous materials i►npaccs associated with the proposed Projecr. Based on rhe
ISIMND analysis, che City concluded that tEie Project would have a less-than-significant impacr and
rac no mitigario is reqieci. (IS/MND at p. 20.}
The IS/MND's conclusions were based on Remediation Iescing and Iesign's August
-/t, 2006 "Reporc of Soil Investigations at 885 Woodside Road and 21 Horgan Avenue, Redwood
C.;iry, <;alifornia" {"RTD Reporc").
