q��-1�2 <br /> WHEREAS, pursuant to Section 33445 of the Community Redevelopment Law, a <br /> redevelopment agency is authorized, with the consent of the legislative body to pay all <br /> or part of the value for and the cost of installation and oonstruction of any building, <br /> facility, structure or other improvement which is publicly owned either within or without a • <br /> project area if the legislative body determines that the buildings, facilities, structures or <br /> other improvements are of benefit to the project area or the immediate area in which the <br /> project is located, that no other reasonable means of financing the buildings, facilities, <br /> structures or other improvements are available to the communiry, and that such <br /> buildings, facilities, structures or other improvements will assist in the elimination of <br /> blighting conditions inside the project area and are consistent with the implementation <br /> plan adopted pursuant to Section 33490 of the Communiry Redevelopment Law; and <br /> WHEREAS, pursuant to and under the circumstances and limitations set forth in <br /> the DDA, in con�ection with the development of the Parcels by the Developer, the <br /> Agency proposes to undertake or help pay for an underground public parking garage <br /> (the "Public Parking Facility"); and <br /> WHEREAS, the City and the Agency certified on October 27, 2000, an <br /> Environmental Impact Report on the Project, and approved on , 2002, an <br /> Addendum to the Environmental Impact Report (referred to collectively as the "Project <br /> EIR"); and <br /> WHEREAS, notice of a joint public hearing by the City Council and the Agency <br /> on approval of the DDA was published in the Redwood City Tribune-The Independent, <br /> on November 23, 2002 and November 30, 2002. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br /> DOES HEREBY RESOLVE AS FOLLOWS: <br /> Section 1. The City Council hereby approves the DDA in substantially the form <br /> on file with the City Clerk, which DDA is incorporated herein by reference. The City <br /> Manager is authorized to execute the DDA on behalf of the City, subject to any minor <br /> clarifying and technical changes as may be approved by the City Attorney. The City <br /> Manager is further authorized and directed to take such actions and execute such <br /> documents as may be necessary to carry out the obligations of the City under the DDA. <br /> Section 2. The City Council hereby finds and determines that the provision of <br /> the proposed Public Parking Facility, in whole or in part, by the Agency in connection <br /> with the development of the Project is of benefit to the Project Areas, that no other <br /> reasonable means of financing the Public Parking Facility is available, and that the <br /> Public Parking Facility will assist in the elimination of blight within the Project Area. <br /> Further, the City Council consents to the Agency providing, in whole or in part, such <br /> Public Parking Facility. <br /> F:Atty/Reso/Reso.1351 <br /> 120502 Z <br />
