EXHIBIT "D" CITY OF REDWOOD CIT~ REDWOOD SHORES LANDSCAPE MAINTENANCE DISTRICT NO. 1995-1 NOTICE OF PROPOSED ASSESSMENT APN: <<APN>> Property Owner <<FirstName>> <<SecondName>> Property Address <<Address 1 >> <<Address2>> Mailing Address <<Address3>> <<Address4>> FY 1997/98 Total District Budget: $115,190.00 FY 1997/98 City Contribution: $13,821.30 FY 1997/98 Total District Assessment: $101,368.70 Your FY 1997/98 Annual Assessment: $<<CurLevy~ Reason for the Proposed Assessment: On December 11, 1995 the City Council of the City of Redwood City established the Redwood Shores Landscape Maintenance District No. 1995-1 (the "District") which provided for the levy of annual assessments on residential and commercial parcels pursuant to a Method of Assessment Spread in an aggregate amount sufficient to pay for estimated annual landscape maintenance expenses associated with public facilities in the District, the landscaping of which benefited privately owned parcels within the District. On November 5, 1996 California voters approved Proposition 218, an amendment to the California Constitution that requires existing, new or increased assessments, beginning July 1, 1997, to be approved by affected property owners pursuant to a majority vote. Each property will receive one ballot that is weighted according to the proportional financial obligation of the affected property. Subsequent to the establishment of the District there were changes to the District's landscape improvement plan which affect the total anticipated landscape maintenance cost. The changes include elimination of a small park and modification of landscaping for that area to reflect part low-maintenance trees, shrubs and perennials and part native habitat wetlands. Additionally, maintenance responsibility for ornamental landscaping in center medians on Embarcadero was transferred from the District to the Lido Neighborhood homeowner's association, and ownership of approximately .6 acres adjacent to The Cove at California Bayside, originally to be dedicated as public land and maintained by the District with native landscaping, was instead retained by The Cove at California Bayside's homeowners association, to be maintained at that homeowners association's expense. Finally, certain other areas of public land originally intended to receive low-maintenance trees, shrubs and perennials will instead reflect native habitat wetlands. These changes, and modifications to the Method of Spread to reflect landscaping changes, changes in the proposed density of residential developments, and changes allocating the cost of general benefits to the City's general fund in order to comply with Proposition 218, are reflected in the Engineer's Report prepared in connection with these proceedings and in the resulting proposed assessment levy. The Engineer's Report is on file with the City Clerk and available for public inspection. Description of Improvements: Approximately 28 acres adjacent to and specifically benefiting the developments known as The Cove at California Bayside, California Seacrest and the Lido Neighborhood will be landscaped at City expense with developer fees collected for such purpose. Improvements will include trails, bike paths and nature observation decks and landscaping that will include irrigation, trees, shrubs, perennials, annuals and other elements, all as more fully described in landscape development plans on record with the City and in the Engineer's Report prepared in connection with these proceedings and on file with the City Clerk. These public improvements are available to the public-at-large, and a portion of the cost of maintaining them in an amount estimated to reflect the public-at-large's enjoyment of the public facilities, will be paid for by the City's general fund. The remainder of the annual maintenance costs will be paid for by parcels within the District by way of an annual levy. The improvements and associated landscaping are not yet fully installed but are expected to be completed over the next two fiscal years. (Over)
