<br />(Page 4, of 20) <br />. <br /> <br />OAKWOOD HOMES <br /> <br />GRANT OF EASEMENTS <br /> <br />AND <br /> <br />DECLARATION OF RESTRICTIONS (CC&Rs) <br /> <br />THIS GRANT OF EASEMENTS AND DECLARATION OF RESTRICTIONS (CC&Rs), dated <br />MAY 212.. ,200.fis executed by OAKWOOD DRIVE RWC. LLC, a California limited <br />liability company ("Declaranf') with reference to the following facts: <br /> <br />A. Declarant owns a 6-lot single family subdivision in Redwood City, California, more <br />particularly described as Lots 1 through 6 (collectively the "Lots') shown on the map <br />entitled 'Oakwood Homes" filed for record on oJ \1of~ 7 , 200l in <br />Book I SS; of Maps at pages 't--9- ~I in San Mateo County, California (the "Map"). <br /> <br />B. The Lots share the common driveway and open space area situated within the <br />easement areas that encumber the Lots shown on the Map. <br /> <br />C. The purpose ofthis Declaration is to grant and describe reciprocal ingress and egress <br />easements over the driveway and open space area in favor of the Lots, to provide for <br />maintenance and repair of the driveway and open space area and other related <br />improvements and to establish the covenants, restrictions, rights, duties, benefits and <br />burdens set forth herein as covenants running with the land and equitable servitudes <br />that benefrt and bind the Lots and each owner and successive owners thereto. <br /> <br />D. The Lot OWners shall be responsible for the continuing permanent permit, <br />maintenance, repair and/or reconstruction of the facilities within the subdivision in <br />accordance with the development approvals issued by the City of Redwood City and <br />as described in this Declaration. In addition, the Development shall remain in <br />compliance with the Redwood City Codes and Regulations at all times. <br /> <br />Article 1 - Definitions <br /> <br />Unless the context indicates otherwise, the following terms shall have the following definitions: <br /> <br />1.1 .QID:. The City of Redwood City, California_ <br /> <br />1.2 Declarant. Oakwood Drive RWC, LLC, a California limited liability company and any <br />successors or assigns thereto as described in Section 6.8. <br /> <br />1.3 Declaration. This Grant of Easements and Declaration of Restrictions (CC&Rs) and any <br />amendments or modifications thereto. <br /> <br />1.4 Development. The six lots shown on the Map. <br /> <br />1.5 Driveway. The portion of the cross-hatched easement area shown on the Map identified as <br />"FI.EE, P.SE, EA.E" that encumbers Lots 1 through 6 that contains the Driveway Improvements. <br /> <br />1.6 Driveway Improvements.
