Driveway Improvements do not include: (i) any utility lines <br />and equipment that provide utility service to the Lots (including, but not limited to, any electrical, water, gas, <br />telecommunication cable or sanitary sewer lines and equipment); (ii) any portion of any walkway situated within <br />the Driveway; or (Hi) any fences that are situated on the perimeter of the Driveway. The Driveway Improvements <br />include only that portion of any se~r line that serves two or more Lots. Sewer laterals are to be maintained <br />by the Lot OWner served by the lateral. The improvements not included are maintained by the Lot Owner(s) <br />whose Lots are served by the Improvements unless maintained by a public or private utility entity or whose Lots <br />on which the sidewalks or fences are located. <br /> <br />1.7 Lot or Lots. Lots 1 through 6 shown on the Map. <br /> <br />1.8 Lot Owner or OWners. The owner of the fee (perpetual) estate in a Lot. <br /> <br />1.9 Maioritv ofthe Lot OWners. The written consent of Owners of four of the six Lots. The consent <br />given by any Owner of a Lot is conclusively presumed to be the consent of all the Owners of that Lot. <br /> <br />1.10 Map. The map entitled "Oakwood Homes" filed for record on JVNe" 7 <br />in Book! 3~ of Maps at pages ?-'1- :3\ in San Mateo County, California. <br /> <br />,200], <br /> <br />1.11 Open Space Area. The portion of the cross-hatched easement area shown on the Map <br />identified as 'Common Open Space Easemenr that straddles Lots 4 and 5 on the Map and contains the <br />portions of the Stormwater Treatment Devices consisting of the detention basin, pipes and gravel bottom <br />bubbler. <br /> <br />1.12 Open Space Area Improvements. The Stormwater Treatment Devices situated within the <br />Open Space Area, including the detention basin, pipes and gravel bottom bubbler and the fences described <br />in Section 3.6. Open Space Improvements do not include the landscaping or irrigation systems situated within <br />the Open Space Area, except as otherwise described in Section 3.4. <br /> <br />1.13 Shared Costs. The cost to maintain, repair, and/or replace the Driveway Improvements and <br />the Open Space Improvements, including normal maintenance costs, and repair and replacement costs, and <br />reasonable administration expenses directly related to the maintenance, repair and/or replacement <br /> <br />1.14 Stormwater Treatment Facilities. The devices and appurtenances constructed within the <br />Development for the express purpose of treating stormwaters pursuant to the City's NPDES Municipal <br />Stormwater Permit, a copy of which is attached as Exhibit A, including area drains, catch basins, pipes, <br />detention basin and gravel bottom bubbler. <br /> <br />1.15 Water Main Line. The water main line and service connector to (and including) each Lot's <br />water meter (but excluding the water meter box) shall be maintained by the City of Redwood City. <br /> <br />Article 2 - Grant of Easements and Restrictions <br /> <br />2.1 Grant of Easement. Declarant grants to each Lot OWner a nonexclusive reciprocal ingress and <br />egress easement in, on and over the Driveway and Open Space Area as the servient tenement in favor of each <br />Lot as the dominant tenement. The easement is for vehicular and pedestrian ingress and egress; for the <br />installation, inspection, maintenance, repair and replacement of any utility improvements that provide utility <br />service to the dominant tenement; for access to the Driveway and Open Space Area and any area immediately <br />abutting the Driveway; and Open Space Area as may be necessary to perform the maintenance described in <br />Section 3.1 below and for access and use of the Open Space Area for passive recreational purposes. utility <br />improvements include, but are not limited to, electrical. water, telephone, gas, telecommunication, fiber optic, <br />cable, sanitary sewer, or storm drainage improvements.
