12/16/96 <br /> <br /> ORIGINAL <br /> <br /> RESOLUTION NO. 12969 <br /> <br /> RESOLUTION OF NECESSITY OF THE CITY OF <br /> REDWOOD CITY INITIATING EMINENT DOMAIN <br /> PROCEEDINGS FOR THE ACQUISITION OF A PORTION <br /> OF THE PROPERTY LOCATED AT 1033 JEFFERSON <br /> AVENUE <br /> <br /> WHEREAS, it is necessary and desirable for the City of Redwood ("City") <br />to acquire title in fee simple to a portion of that certain real property (hereinafter <br />"Property") known as 1033 Jefferson Avenue, more particularly described in <br />Exhibit "A," attached hereto and by this reference made a part hereof; and <br /> <br /> WHEREAS, the portion of real property (the "Subject Property") to be <br />acquired by City is described on Exhibit "B," attached hereto and incorporated by <br />this reference; and <br /> <br /> WHEREAS, the portion of real property (the "Temporary Easement") to be <br />acquired by City as a temporary construction easement is described on Exhibit <br />"C," attached hereto and incorporated by this reference; and <br /> <br /> WHEREAS, the public use for which the Subject Property is to be taken is <br />the construction by the City of Redwood and use by the public of a vehicular and <br />pedestrian underpass and incidental use (the "Project"); and <br /> <br /> WHEREAS, the City is authorized to acquire real property by eminent <br />domain pursuant to Section 37350.5 of the Government Code; and <br />WHEREAS, nbtice has been given as required by Section 1245.235 of the <br /> <br />Code of civil Procedure, and a hearing was regularly held by the City Council on <br />the /~'r'~'day of December, 1996, at which all persons shown as having an <br /> <br />Reso-101 1 <br />G:/shared/Redwood/Council <br />11/19/96 <br />FXS:rg <br />11/25/96 <br />FXS/fs <br /> <br /> 12969 <br /> <br /> <br />
