(\'.f ~ ~ t~ ii:.."'~ iL. <br /> <br />AGREEMENT <br /> <br />LEASE AGREEMENT - COMMUNlCA TION SITE <br /> <br />(PGE TOWER, REDWOOD 70RES P~W A Y ~ RADIO ROAD) <br />THIS LEASE ("Lease"), dated P' g 2007 is made by and between the CITY OF <br />REDWOOD CITY, a municipal corporation of the State of California ("Lessor") and MetroPCS California <br /> <br />LLC, a Delaware limited liability company, d/b/a MetroPCS ("Lessee"). <br /> <br />RECITALS <br /> <br />WHEREAS, Lessor is the owner of certain property situated in San Mateo County, State of <br /> <br />California, commonly known as 1000 Radio Road (APN 095-443-010), and described in Exhibit "A", <br /> <br />attached hereto and incorporated by reference (the "Site"); and <br /> <br />WHEREAS, the Site is improved by a tower owned, maintained and operated by Pacific Gas and <br /> <br />Electric Company; and <br /> <br />Whereas, a portion of the Site is used by T-Mobile pursuant to a lease agreement with the City of <br /> <br />Redwood City and agreement with Pacific Gas and Electric Company; and <br /> <br />WHEREAS, Lessee is a limited liability company organized under the laws of the State of <br /> <br />Delaware whose principal business is to provide mobile radio/telephone service; and <br /> <br />WHEREAS, Lessee desires to use a portion of the Site and Lessor is willing to permit Lessee to <br /> <br />lease a portion of the Site in accordance with the terms, conditions and covenants of this Lease. <br /> <br />NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: <br /> <br />DEFINITIONS: <br /> <br />"Anniversary Date" means the annual recurrence of the date first set forth above. <br /> <br />"Antenna" means an installation of an array of up to six (6) antennas to receive or transmit radio <br /> <br />signals sues in wireless communications. <br /> <br />"Lease Year" means 365 consecutive calendar days (except for Leap Year) commencing on the <br /> <br />Commencement Date and upon each subsequent Anniversary Date. <br /> <br />1. PREMISES. Lessor hereby leases to Lessee and Lessee leases from Lessor for the term, <br /> <br />at the rental and upon all of the conditions set forth herein, a portion of that certain real property referred to <br /> <br />herein as the Site, consisting of approximately one hundred and fifty (150) square feet (the "Leases <br /> <br />Lease Agreement-Communications Site - PGE Tower (Redwood Shores Parkway and Radio Road) - Final Rev3 (5/18/07) <br /> <br />1 <br />
