I <br /> <br />Premises") described on Exhibit "B," attached hereto and incorporated by this reference, within which <br />Lessee desires to construct and maintain improvements and equipment, as described on Exhibit "C," <br />attached hereto and incorporated by this reference. Lessor and Lessee hereby agree that the Leased <br />Premises including any Access Areas (dermed below) may be surveyed by a licensed surveyor at the sole <br />cost of Lessee, and such survey shall then supplement Exhibit "B," and become a part hereof and shall <br />control to describe the Leased Premises and Access Areas in the event of any discrepancy between such <br />survey and the description of the boundary of the Leased Premises contained herein. <br />2. TERM; OPTION. (a) The terms of this Lease (the "Term") shall be Five (5) years <br />commencing on , 2007, (the "Commencement Date") and terminating on the Fifth <br />anniversary of the Commencement Date, unless earlier terminated as provided in this Lease; (b) Lessee is <br />granted Two (2) consecutive Five (5) year renewal terms (collectively, the "Renewal Terms"), commencing <br />upon the expiration of the Term. Each Five (5) year Renewal Term ~hall automatically renew unless Lessee <br />notifies Lessor in writing at least ninety (90) days prior to the contmencement of each Renewal Term that <br />the Lease is not to be renewed. <br />3. RENTAL. (a) Lessee shall pay to the Lessor as rent during the Term for the Leased <br />Premises in advance on the Commencement Date and on each yearly anniversary date thereof without <br />deduction, offset, prior notice or demand, in lawful money of the United States, the sum of Twelve <br />Thousand and No/lOO Dollars ($12,000) per Lease Year; (b) There shall be a four (4) percent increase in <br />the rent commencing on the fifth Lease Year. The rent during the fifth Lease Year shall therefore be <br />Twelve Thousand Four Hundred Eighty Dollars and No/I00 ($12,480). Thereafter, there shall be a yearly <br />increase of four percent (4%) on each Anniversary Date overofthe rent set duringpad for the immediately <br />preceding Lease Year. previous year. <br />In the event that this Lease is terminated by mutual agreement prior to the expiration of any Term, <br />Lessee shall be reimbursed for the remaining paid rent on a prorated basis (365 day basis), subject to any <br />offsets for past rent due or other costs, if any. <br />4. USE. <br />4.01 Permitted Uses.
