<br />Concurrently with the execution of this Lease, Lessee shall furnish Lessor with certificates and <br />declaration pages of the insurance required hereunder and, with respect to evidence of commercial general <br />liability and automobile liability insurance coverage, original endorsements: <br />(i) Precluding cancellation or reduction in coverage before the expiration of Thirty (30) days <br /> <br />after City shall have received written notification of cancellation or reduction in coverage by fITSt class <br /> <br />mail; <br /> <br />(ii) Providing that Contractor's insurance shall apply separately to each insured against <br />whom claim is made or suit is brought, except with respect to the limits of the insurer's liability (cross~ <br />liability endorsements); <br />(iii) Naming City, its Council, commissions, boards, committees, officers, employees and <br />agents as additional insureds; and <br />(iv) Providing that Lessee's insurance shall be primary insurance relating to Lessee's work <br /> <br />hereunder with respect to City, its Council, commissions, boards, committees, officers, employees and <br /> <br />agents, and further providing that any insurance or self~insurance maintained by City for itself, its Council, <br />commissions, boards, committees, officers, employees and agents shall be in excess of Lessee's insurance <br />and shall not be contributory with it. <br />(c) Fire and Extended Coverage Insurance. Lessee shall maintain a policy of <br />standard fire and extended coverage insurance on the buildings on, and the improvements to, the Leased <br />Premises. <br /> <br />7. DAMAGE, DESTRUCTION AND TERMINATION. <br /> <br /> <br />7.01 Right to Terminate. The Lease may be terminated on Thirty (30) days prior written <br /> <br /> <br />notice as follows: (i) by either party upon a default of the covenant or term hereof by the other party, <br /> <br />which default is not cured within Thirty (30) days of mailing of written notice of default, provided that the <br /> <br /> <br />grace period for any monetary default is Ten (10) days from mailing of notice; or (ii) by Lessee if it cannot <br /> <br /> <br />obtain or maintain through no fault of its own any license, permit or other approval necessary for the <br /> <br /> <br />construction and operation of the Lessee's Facilities; or (iii) by Lessee if Lessee is unable to occupy and <br /> <br /> <br />utilize the Leased Premises due to an action of the Federal Communications Commission, including <br /> <br /> <br />without limitation, a take back of channels or change in frequencies; or (iv) by Lessee if Lessee determines <br /> <br />Lease Agreement-Communications Site - PGE Tower (Redwood Shores Parkway and Radio Road) - Final Rev3 (5/18/07) <br /> <br />10 <br />
