<br />that the Leased Premises are not appropriate for its operations for economic or technological reasons, <br /> <br />including, without limitation, signal interference. <br />Upon termination, Lessee shall remove all of Lessee's communications equipment from the <br /> <br />Leased Premises and shall restore the Leased Premises to its original condition, except for normal wear and <br /> <br /> <br />tear, and Lessee shall be obligated to pay any accruing Rent prior to the date of termination of this Lease. <br /> <br /> <br />7.02 Destruction or Condemnation. Ifthe Leased Premises or Lessee's Facilities are damaged, <br /> <br /> <br />destroyed or condemned, Lessee may elect to terminate this Lease by giving written notice to Lessor no <br />more than Forty Five (45) days following the date of such damage, destruction, or condemnation. The <br />Lease shall terminate Thirty (30) days from the date of the notice. If Lessee chooses not to terminate this <br />Lease, Rent shall be reduced or abated in proportion to the actual reduction or abatement of use of the <br />Leased Premises. <br />8. TAXES. Any and all real property tax, or any vther form of tax assessed or imposed <br />against the Leased Property arising out of, or attributed to, Lessee's occupancy and use of the Leased <br />Premises, shall be borne exclusively by Lessee. Lessor shall, during the term hereof, make payment of all <br />real property taxes in general and special assessments levied against the Site and the Leased Premises, <br />which it has the duty to pay. Lessor shall make such payments in order to avoid penalty. Lessee shall <br />compensate Lessor for any real property taxes directly attributable to the value of Lessee's improvements <br />on the Leased Premises, which payment shall be made by Lessee to Lessor within Fifteen (15) days after <br />the date Lessee receives written notice from Lessor of the amount due. Lessor's notice to Lessee shall <br />provide documentation reasonably satisfactory to Lessee of the amount of Lessee's portion of such real <br />property taxes. <br />9. UTILITIES. <br />9.01 Payment. Lessee shall pay for all water, gas, heat, light, power, telephone and other <br />utilities and services, if any, supplied to the Leased Premises, together with any taxes thereon. <br />9.02 Access to Electricity and Other Utilities. Lessee shall be solely responsible for bringing <br />electricity and/or other utilities to the Leased Premises. Lessor does not warrant the present and/or future <br /> <br /> <br />availability of utilities to the Site. Lessee also has the right to bring only underground utilities across the <br /> <br /> <br />Site in order to service the Leased Premises.
