<br />7A <br />Page 42 <br /> <br />61. Shopping carts shall be maintained on site. The store operations shall abide <br />by the City's shopping cart ordinance. <br /> <br />62. Vending machines shall not be placed outside the building in any location. <br /> <br />63. The store management shall maintain adequate on-site refuse and recycling <br />containers in trash enclosures. All containers shall be air and water tight and <br />shall not release odors. Recycling is required by State Law. <br />" <br /> <br />64. The applicant shall provide freestanding trash and recycling containers <br />adjacent to the entrances and/or dining areas. <br /> <br />65. The store management shall ensure that the site is cleaned daily. Trash, litter <br />and spills shall be removed promptly so as to not create a nuisance condition. <br /> <br />66. There shall be no unenclosed outside storage on the site. All palettes, boxes. <br />tires, and other merchandise shall 'be immediately brought into the warehouse <br />or removed from it, but not allowed to remain outside the building for more <br />than the reasonable time period for relocating it as necessary. <br /> <br />67.AII tire installation activities shall occur completely inside the tire center. No <br />auto repair of any kind shall occur outside the building. <br /> <br />68.ln association with the wide range of merchandise offered by this retail <br />business, alcoholic beverages for off-site consumption may be sold from <br />these premises subject to the Alcoholic Beverage Control Board approval. <br />Sales of alcoholic beverages from this entity are considered by the City to be <br />accessory to the overall use and similar to large grocery store sales in this <br />case. <br /> <br />69. The applicant shall incorporate a graffiti abatement program and shall ensure <br />that the retail warehouse building surfaces are coated and otherwise <br />protected to allow for ease of graffiti removal. <br /> <br />70.Planning Services shali submit a favorable inspection report prior to issuance <br />of any occupancy permit or acceptance of off-site improvements by other City <br />divisions and departments. <br /> <br />Use Permit: Gas Station <br /> <br />The Zoning Administrator adopted the Mitigation Monitoring Reporting Program <br />and approved a Use Permit for a gas station with 12 vehicle fueling positions <br />based on the site plan for the "Expanded Warehouse and Relocated Gas Station" <br />Alternative studied in the Environmental Impact Report, pursuant to Article 17, <br />section 4.E and Article 35 of the Zoning Ordinance. The approval is based on the <br />following Findings and subject to the Conditions of Approval: <br /> <br />Page 15of21 <br />
