7B <br /> ATTACHMEI�R�ge 2O <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE ClTY OF RE�WQOD CITY, CAUF4RNfA, <br /> ADi3iNG ARTiCLE XVi T� CHAPTER 18 {L��AL IiviN��VEMENI"S . <br /> AND PLANNING) OF THE C[TY CODE REGARDING THE PARKS <br /> IMPACT �EE AND SETTING THE RATES FOR SUCH FEE <br /> THE CITY COUNCIL OF THE C1TY OF RE�W04D CITY DOES ORDAIN AS <br /> FOLLOWS: <br /> Section 1. F�ndinq�. The City Counci! find� and declares that: <br /> (a) In order to provide services to future development in the City, tne City <br /> must expand and improve its system of parks, parkland, and recreation facilities. <br /> (b) The City has engaged Economic & Pianning Systems to prepare a study, <br /> entitled "Revised Technica{ Memarandum" and dated March 8, 2007 by Economic & <br /> Pfanning Systems (EPS) (the "Study"), describing new and improved facifities that are <br /> needed to mitigate the anticipated demands of new development (the "Program"). The <br /> Study, which is on file in the Office of the City Clerk, is incarporated herein by reference. <br /> (c) The Mitigation Fee Act (Section 66Q00 et seq. of the California <br /> Government Code) and Articfe XI, Section 7 of the California Constitutian authorizes the <br /> City ta levy a fee upon development projects to defray aEl or a portion of the casts of <br /> pubiic facilities (including public improvements and public amenities) refated to the <br /> develapment project. <br /> (d) The City desires to impose a fee, to be known as the "Parks Impact Fee," <br /> _ <br /> upon development projects, for the purpose of funding the eosts of the Program (the <br /> "Fee"). The Fee, its methodology, and the ca(culatians supporting its methodology, are <br /> set forth in this Ordinance and more completely anaEyzed in the Study. <br /> (e) The Study estimates the costs of each element of the Program and <br /> substantiates a methodalogy for the Fee that will charge each new development <br /> projects only for the portion of the costs of the Program necessary to mitigate the <br /> ;mpacts expected to be caused by that develapment �roject. <br /> (f) There is a reasonable relationship between the need for the Pragram and <br /> the development prajecfs on which the Fee will be imposed because such new <br /> development projects will create an additional demand on City services, requiring the <br /> expansion af the facilities to provide such services. <br /> (g) There is a r�asonab[e relationship 6etween fihe Fee's use and <br /> development projects on which the Fee will be imposed because the Fee will anly fund <br /> the portion of Project costs necessitated by each new develapment. <br /> (h) The Fee cioes not exceed the estimated reasonable cost of providing the <br /> €actlities for which the Fee is imposed.
