7B Page 28 18.265 (nteraction with Parkland Dedication Requirements Where a Development would otherwise be subject both to the requirements of Article 12 af Chapter 3Q ofi this Code and a requirement of payment of Impact Fee, the Development shall be exempt from fihe portion of the Impact Fee far the acquisition of land, but not from any other portion of the Fee, and shaEl be subject to the requirements of Article 12 af Chapt�r 30 of this Code." Section 4. Initial Rate. The inifiial impact fee schedule for the fee imposed pursuant �o Section 18.258 of the City Code, as adopted hereby, shall be as shown in Tab1� 11 af the Revised Technica) Memorandum dated March 8, 2Q07, which is attached hereto and incorporated herein as Attachment "A", except that each amounfi shown in such tabfe shail be mulfiiplied by a factor of 50%.. For purposes of Section 18.265 of the City Code, 17.2% of each such rate shall be deemed the portion of the fee fer the Site (mprouement Costs and Park Improvement Cost� per Acre. These ratej may be revised by resolution or ardinanca of the city cauncil and shall be subjec# to automatic annual adjustment as pravided in Secfiion 18.259 of the Redwood City Code adopted hereby. Secfion 5. CEQA Findinq. Based on the Planning Commission's adoption of the Initial Study and Negative Declaration {IS/ND} prepared by the City for the Active Parkland Standard and Parkland Dedication and in-Lieu Ordinance on April 3, 2007, the City Cauncil finds that adoption of the proposed Parks Impact Fee �rdinance will not have a significant effect on the enviranment. No specific park projects are assaciated with the establishment af an Active Parkland Standard and adoption of parkland dedicafiion and in-lieu fee ordinances. The proposed _ _ __ _ _ . _ _ praject is palicy-oriented and would establish a park standard and create a funding mechanism for future park development. When and if specific park prajects are developed and proposed for implementation, the environmental impacts of such facilities wauEd be evaluated in accordance with CEQA and City practice. Section 6. Relationship to Prior Law. The terms af this Ordinance shall apply to a!! Qevelopments (as that term is defined in sec#ion 18.257 of the City Cade as adoptad hereby) in the City, except with respect ta any portion of a project for which a building permit has been issued. Section 7. Severabilitv.If any provisian, sec#ion, paragraph, sentence or word of this Ordinance, or the application thereof to any person or circumstance, is rendered or declared invalid by any court of competent jurisdiction, the remaining provisions, sections, paragraphs, sentences or words of this Ordinance, and their application ta other persons or circumstances, shall not be affected thereby and shall remain in full force and effect and, to that end, the provisions of this Ordinance are severable.
