Initial Rate. The inifiial impact fee schedule for the fee imposed <br /> pursuant �o Section 18.258 of the City Code, as adopted hereby, shall be as shown in <br /> Tab1� 11 af the Revised Technica) Memorandum dated March 8, 2Q07, which is <br /> attached hereto and incorporated herein as Attachment "A", except that each amounfi <br /> shown in such tabfe shail be mulfiiplied by a factor of 50%.. For purposes of Section <br /> 18.265 of the City Code, 17.2% of each such rate shall be deemed the portion of the fee <br /> fer the Site (mprouement Costs and Park Improvement Cost� per Acre. These ratej <br /> may be revised by resolution or ardinanca of the city cauncil and shall be subjec# to <br /> automatic annual adjustment as pravided in Secfiion 18.259 of the Redwood City Code <br /> adopted hereby. <br /> Secfion 5. CEQA Findinq. Based on the Planning Commission's adoption of <br /> the Initial Study and Negative Declaration {IS/ND} prepared by the City for the Active <br /> Parkland Standard and Parkland Dedication and in-Lieu Ordinance on April 3, 2007, the <br /> City Cauncil finds that adoption of the proposed Parks Impact Fee �rdinance will not <br /> have a significant effect on the enviranment. <br /> No specific park projects are assaciated with the establishment af an Active Parkland <br /> Standard and adoption of parkland dedicafiion and in-lieu fee ordinances. The proposed <br /> _ _ __ _ _ . _ _ <br /> praject is palicy-oriented and would establish a park standard and create a funding <br /> mechanism for future park development. When and if specific park prajects are <br /> developed and proposed for implementation, the environmental impacts of such <br /> facilities wauEd be evaluated in accordance with CEQA and City practice. <br /> Section 6. Relationship to Prior Law. The terms af this Ordinance shall <br /> apply to a!! Qevelopments (as that term is defined in sec#ion 18.257 of the City Cade as <br /> adoptad hereby) in the City, except with respect ta any portion of a project for which a <br /> building permit has been issued. <br /> Section 7. Severabilitv.If any provisian, sec#ion, paragraph, sentence or word <br /> of this Ordinance, or the application thereof to any person or circumstance, is rendered <br /> or declared invalid by any court of competent jurisdiction, the remaining provisions, <br /> sections, paragraphs, sentences or words of this Ordinance, and their application ta <br /> other persons or circumstances, shall not be affected thereby and shall remain in full <br /> force and effect and, to that end, the provisions of this Ordinance are severable. <br /> Sect'ron 8.
