6.1 B <br /> #enant irnprovements, the spatial limitations of the pavilions, and the uncertainties of Page 2 <br /> pioneering food services in Courthouse Square has caused staff to question whether <br /> the original goals can be met unless there is some re-thinking of how best to utiiize the <br /> pavilions. Therefore, the Committee has asked staff ta come back with a list of options <br /> and pro's / con's for ather approaches. Concurrently, it was generally agreed that <br /> maving ahe�d with this first fease will provide valuable additional experience with a <br /> willing vendor, so staff is recommending that Council aufihorize the lease and license <br /> within this framework. <br /> Daily Boost LLC Lease <br /> Daily Boost LLC proposes to operate a coffee, smoothies, breakfasf sandwiches, <br /> muffins, fruit cups, and light snacks concession called "Daily Boost" within Lease Area <br /> 1 B loca#ed near the Courthause building along Middlefield in Cour#house Square as <br /> shown in Exhibit A. Daiiy Boost wiii enter into a iease wi#h ihe Agency for ihe i 9�i <br /> square foot area. The expected o�ening date of Daily Boost is November 2Q07. The <br /> key terms af the lease consist of the following: <br /> • Initial five year term; <br /> • Two five-year options; and <br /> • Lease rate of$3.00 per square foot. <br /> In an effort to ensure a successfu! start, Daily Boost wil( pay $1.00 per month to the <br /> Agency for the first six months, commencing November 1, 2Q07 to ease its business <br /> start-up costs and aperations. Since Daily Boost wilf likely be the only vendor in <br /> operatian for the first few months, this provision wouid allow fior a ramp-up period, until <br /> all vendor spaces are occupied and operating. As a result, more activi#y is expected <br /> and full charges will be implemented at that time. <br /> Daily Boost LLC License <br /> Daily Boost LLC will enter into a license with the City for License Area 1 B as shawn in <br /> the plat map and fegal descripfion as Exhibit A in the License Agreement. The license <br /> area, measuring approximately 43' x 36` (1,360 square feet) will have 16 tables and 32 <br /> chairs provided by the City far Daily Boost's use, and shall be available to the pub(ic <br /> without purchase requirement during Daily Boost's hours af operations. Daily Boost wif! <br /> #ake out, elean, and bus the #ables and chairs during hours of aperations. !f the tabies <br /> and chairs need to be available to the public before and/or after Daily Boost's hours of <br /> aperation, the Cify shail be responsible for the profiection o�the tdbles and chairs. <br /> The key terms of the license agreement consist of the following: <br /> • Month-to-month term <br /> • License fee of$.06 per square foot per month for a tota! of $81.75 per month <br /> • Common area maintenance of$600 per month <br /> The license fee is a nomina! amount to encourage Daily Boast to clean and secure the <br /> tables and chairs provided by the City. The common area maintenance charge of$600 <br /> per month commences November 1, 2007. <br /> License fees collected will fund City sponsored or co-sponsored special events at <br /> Courkhouse Square.
