6.1 B <br /> Page 5 <br /> LEASE AGREEMENT <br /> (Lease Area 1 B) <br /> THIS LEASE AGREEMEl�!T ("Agreemen#" or "LEP.SL�") is entered into as af , <br /> 2007, by and between: the Redevelopment Agency of the City of Redwood City, a public body, <br /> corporate and politic, du[y organized and existing under the laws af the State ofi California <br /> ("Agency" or "Lessor"), and Daily Boost LLC, d.b.a. "Daily Bnost", hereinafter referred to as <br /> "Lessee". <br /> RECITALS: <br /> A. WHEREAS, on May 3, 2005, the City of Redwaad City ("City"} entered into an <br /> agreement with the Counfy of San Mafeo, "Coaperative Agresment between the <br /> Caunty of Sart Mateo and the City of Redwood City for Preservation af the Historic <br /> County Courthouse Slock, Removal of the South Annex, Reconstruction of the <br /> Courthouse Fa�ade and Creation of a Courthouse Plaza, and Granf of Easement <br /> and License", herein ("Caoperative AgreemenY'). <br /> B. WHEREAS, the Coaperative Agreement was amended on August 24, 2406 thraugh <br /> the First Amendment to the Cooperative Agreement between the County of San <br /> Mateo and the City of Redwood City far Preservation of the Historic County <br /> Courthouse Block, Remaval of the South Annex, Reconstruction of the Courthause <br /> Fa�ade and Creation of a Courthouse Plaza, and Gran# of Easement and License <br /> ("First Amendmen#") to expand the Project to include the construction and piacement <br /> nf a restroom facility. <br /> C. WHEREAS, the Cooperative Agreement provides that fhe City may assign its <br /> easement interest in any or all portions of the Courthouse Square with the consent of <br /> the County. <br /> D. WHEREAS, pursuant ta a Partia( Assignm�nt and Assumption of Caoperative <br /> Agreemenf, the City has assigned certain interests in the four Concession Spaces at <br /> Courthouse Square to the Agency. <br /> E. WHEREAS, Lessor has possession of Courthouse Square Concession Space <br /> idgntified as Lease Area 9 B (the"Premises" or the"Lease Area"), as described in the <br /> legal description and pla# map identified as Exhibit "A" and illustrated in the site <br /> iayout identified as Exhibifi B, both of which are attached hereto and incorporated <br /> herein by reference. <br /> F. WHEREAS, Lessee, Ruhina Karmali {60% awner), Nazir Karmali {20°/o owner), and <br /> Nishila Karmali (20°/a owner) of Daily Boost, LLC wishes to lease the Premises for <br /> aperation of Daily Boost, a coffee, smoothie, break#ast snack, and sandwich <br /> concession. <br /> G. WHEREAS, Lessor and Lessee wish to enter into an agreement for the use of the <br /> Premises by Lessee, its agents, customers, contrac#ors, and assignees. <br /> H. WHER�AS, concurrently with this Lease Agreement, City and Lessee have entered <br /> into a License Agreement (the "l.icense Agreement") af(owing Lessee the right to use <br /> cerfain areas surraunding the Premises, defined as License Area 98. <br /> ATTY/AGR/200?.067 1 <br />
