Lessee acknowfedges that it will be accep#ing the <br /> Premises in its completed condition per building plans that were corrtpletad by <br /> FMG Architects, Bid Sets, �'ebruary 10, 2006 ("Bid Sets"). Said Bid Sets have <br /> been reviewed by Lessee, and are incorporated h�rein by this reference. Lessee <br /> sha!( have the right ta measure the size af the Lease Area to insure size <br /> accuracy. The Lease provisions may be adjusted according to such <br /> measurements prior#o the execution of the Leas�. <br /> 2. LEASE PERIOD <br /> 2,1 Term. The term of this Agreement shaq be far five years, commencing upon the <br /> dafe of the lease execution day (Lease Commencement Date), and ending on <br /> November 1, 2017 ("Lease Expiration Date"). <br /> 2.2 Options. Lessee shall have two options ("Options"} ta extend fhe l.ease Term <br /> for two successive five year periods ("Ext�nded Terms"). Each �ption shall be <br /> exercised no earlier than one (1) year, but no later than 60 days prior to the lasf <br /> day of the �ease Term by written notice to Agency. Rent for the Extended Term <br /> shal! be as described in Section 3. All other terms and conditians of fhis Lease <br /> shalf remain in full force and effect during the Extended Term. <br /> 2,3 Definition. As used in this Lease the word "Option" has the following meaning: <br /> (1) the right or option to extend the term of this Lease. <br /> 2.4. Option Exclusive. The Option granted to Tenant in this Lease is exclusive to <br /> Tenant and may not be exercised or be assigned, voluntarily or involuntarily, by <br /> or to any person or enfify other than Tenant. <br /> 2.5 Delay in Passession. On the Lease Commencement Date, Lessee shall take <br /> possession of the Premises. If Lessee's ability to take possession by the date as <br /> set forth in this provision is delayed as a result of any of the foflowing causes, the <br /> date for deEivery sha!! be postponed without penalty to Lessee for a period of time <br /> equivalent to the period caused by such deiay: <br /> (a) acts of Lessar, its agents, or employees; <br /> (b) acts of Gad which Lessee could not reasonably have foreseen or guarded <br /> against; <br /> (c) any strikes, boycotts or like obstructive actions by employees or labar <br /> organizations and which are beyond the controi af Lessee and which <br /> cannot be reasonably overcome; ar <br /> (d) res#rictive regulatians by the Federa!
