05/06/2019 <br />12. Annual Reporting to City. Permittee shall submit a report to City annually, <br />upon commencement date of PDD Operations. Along with the annual report, Permittee <br />will work with City to conduct a customer satisfaction survey for residents utilizing PDD <br />services in Redwood City. The annual report will include the following: <br />A. Public Benefit Measures. <br />i. Total number of miles all PDD traveled within the boundaries of the <br />City of Redwood City. <br />ii. Total number of partnerships Permittee has entered into with <br />Redwood City businesses. <br />iii. CO2 emissions reduction in the City: a calculation based on personal <br />trips and deliveries that would have been made by traditional <br />combustion engines but were instead made by Permittee's PDDs. <br />B. Operational Data. <br />i. Complaints received regarding accidents and injuries, and <br />Permittee's response or resolution; all incidents reported to the <br />Police Department; all incidents where private property damage <br />exceeded Two Hundred Dollars ($200). <br />ii. Number of PDD technical failures and response time for resolution. <br />13. Permittee shall not use or permit the use of any PDD in any manner that <br />creates or has the potential to create a nuisance or in a way that compromises the public <br />health, safety, or welfare, or the public's use of the Right of Way. <br />14. All of Permittee's activities shall be performed at Permittee's sole cost, risk <br />and expense. This PDD Agreement does not entitle Permittee to install any improvement <br />on any property within the City. <br />15. Compliance with Laws. Permittee shall comply with all applicable federal, <br />state, and local laws, rules, and regulations and shall obtain all applicable licenses, <br />required for Permittee's business operation in the City and use of the Right of Way or any <br />activity, work, or thing done, permitted, or suffered by Permittee in or about the Right of <br />Way. <br />16. Choice of Law. This PDD Agreement and the PDD Permit shall be <br />construed and interpreted in accordance with the laws of the State of California, excluding <br />Page 18 of 20 <br />ATTY/DOCS-RESOLUTIONS/2019/RESO.0042 CC RESO PDD PILOT PROGRAM RESO.
