6.H. - Page 22 of 28 <br />1 <br />ATTACHMENT B <br />"The only information on this website that is posted with the intention of reaching <br />the investing public, including bondholders, rating analysts, investment advisors, <br />or any other members of the investment community, is located on the investor <br />information web pages. Other than the specific information presented in the <br />investor information web pages, no other information on the City's website is <br />intended to be the basis of or should be relied upon in making an investment <br />decision. Because each security issued by the City or its related entities may <br />involve different sources of payment and security, you should refer for additional <br />information to the official statement and continuing disclosure filings for the <br />particular security. The information posted in the investor information web pages <br />speaks only as of its date." <br />The investor information of the City's website shall include the following statement on each <br />page of the City's investor website section that shall read: <br />"All information contained on this website is obtained from sources believed to be <br />accurate and reliable. While all information presented is believed to be accurate <br />and reliable, it is prepared without audit unless otherwise identified as audited <br />financial information. Due to the possibility of human or mechanical error and other <br />factors, this information is provided as is without warranty of any kind and the City <br />makes no representation, express or implied, as to the accuracy, reliability, <br />completeness or timeliness of this information, and is not responsible for any loss <br />or damage incurred by any party using this information. This website and the <br />information contained herein do not constitute an offer to sell or the solicitation of <br />an offer to buy any securities." <br />Other Public Statements. The Disclosure Coordinator is not required to review all public <br />statements made by officials of the City.- However, whenever the City makes statements or <br />releases information that would be material to an investor in the City's bonds (e.g., could have a <br />material impact on the ability of the City to repay one of more of its bond issues) and that is <br />intended (or reasonably can be expected) to be accessible to and relied upon by investors or <br />potential investors in the City's bonds, the City is obligated to ensure that such statements and <br />information are complete, true, and accurate in all material respects. The City can minimize <br />(although not eliminate) the risk of materially inaccurate public statements if it files current <br />comprehensive disclosure information on EMMA and/or its website in accordance with this <br />Disclosure Policy. In addition, to the extent that the Disclosure Coordinator becomes aware of a <br />materially inaccurate public statement made by an official of the City reasonably accessible to <br />and material to investors, the Disclosure Coordinator shall attempt to have such information <br />publicly corrected. <br />Training <br />The Disclosure Coordinator shall ensure that the members of the City staff involved in the <br />initial or continuing disclosure reporting process and members of the City Council are properly <br />trained to understand and perform their responsibilities.
