Biological Resources Impact BR -1: Development of the Project would have the potential <br />to disturb pallid bat and western red bat, which could roost in on-site buildings and trees. <br />Mitigation Measures. Mitigation Measures BR -la, BR -lb and BR -lc will be <br />implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact BR -1. The City Council hereby finds <br />that incorporating the requirements of Mitigation Measures BR -la, BR -lb and BR -lc into <br />the Project would substantially lessen the severity of Impact BR -1, such that this potential <br />impact would be less than significant, because these measures will require surveys to <br />determine the presence of bats prior to any demolition or tree removal activities; avoidance <br />of active bat roosts if feasible, and if avoidance is not feasible, compensation for any <br />impacts to bats. This finding is based on the entire record of proceedings for the Project, <br />including but not limited to the discussion and analysis set forth on pages 4.3-7 through <br />4.3-8 of the DEIR, which includes a full statement of the impact and applicable mitigation <br />measures and is hereby incorporated herein in its entirety. <br />7. Biological Resources Impact BR -4: Development of the Project could affect nesting birds <br />and/or pallid bat maternity colonies. <br />Mitigation Measures. Mitigation Measures BR -4a and BR -4b will be <br />implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact BR -4. The City Council hereby finds <br />that incorporating the requirements of Mitigation Measures BR -4a and BR -4b into the <br />Project would substantially lessen the severity of Impact BR -4, such that this potential <br />impact would be less than significant, because these measures will require surveys to <br />determine the presence of nesting birds or bats prior to specified construction activities; <br />implementation of specific measures to avoid nesting bird impacts; and avoidance of active <br />bat roosts if feasible and if avoidance is not feasible, compensation for any impacts to bats. <br />This finding is based on the entire record of proceedings for the Project, including but not <br />limited to the discussion and analysis set forth on pages 4.3-7 through 4.3-10 of the DEIR, <br />which includes a full statement of the impact and applicable mitigation measures and is <br />hereby incorporated herein in its entirety. <br />8. Cultural Resources Impact CR -2: Development of the Project could cause a substantial <br />adverse change in the significance of an archaeological resource pursuant to CEQA Guidelines <br />Section 15064.5. <br />Mitigation Measures. Mitigation Measures CR -2a and CR -2b will be <br />implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact CR -2.
