This finding is based on the entire record of proceedings for <br />the Project, including but not limited to the discussion and analysis set forth on pages 4.2- <br />23 through 4.2-29 of the DEIR, which includes a full statement of the impact and applicable <br />mitigation measures and is hereby incorporated herein in its entirety. <br />4. Air Quality Impact AQ -4: Construction activities associated with the Project could <br />expose sensitive receptors to substantial concentrations of TAC, exceeding the applicable <br />cancer risk threshold. <br />Mitigation Measures. Mitigation Measure AQ -2b will be implemented for the <br />Project as provided in the MMRP. <br />Findings Regarding Impact AQ -4. The City Council hereby finds <br />that incorporating the requirements of Mitigation Measure AQ -2b into the Project would <br />substantially lessen the severity of Impact AQ -4, such that this potential impact would be <br />less than significant, because Mitigation Measure AQ -2b requires all construction <br />contractors to use construction equipment that meets or exceeds EPA Tier 4 Final <br />emissions standards and to take other steps to reduce emissions of nitrous oxides from <br />construction equipment to satisfy the Bay Area Air Quality District's regional significance <br />threshold for such emissions, and the resulting cancer risk would not exceed the Air Quality <br />District's threshold for sensitive residential receptors. This finding is based on the entire <br />record of proceedings for the Project, including but not limited to the discussion and <br />analysis set forth on pages 4.2-23 through 4.2-29 of the DEIR, which includes a full <br />statement of the impact and applicable mitigation measures and is hereby incorporated <br />herein in its entirety. <br />5. Air Quality Impact AQ -6: Implementation of the Project would cumulatively contribute <br />to air quality impacts in the Air Basin. <br />Mitigation Measures. Mitigation Measures AQ -2a and AQ -2b will be <br />implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact AQ -6. The City Council hereby finds <br />that incorporating the requirements of Mitigation Measures AQ -2a and AQ -2b into the <br />Project would substantially lessen the severity of Impact AQ -3, such that this potential <br />impact would be less than significant, because with the implementation of Mitigation <br />Measures AQ -2a and AQ -2b, regional and localized construction emissions would not <br />exceed the Air District significance thresholds, and the Project would not cumulatively <br />contribute to the nonattainment designations of the Air Basin.
