7.A. - Page 29 of 141
the Project as provided in the MMRP.
Findings Regarding Impact AQ -2a. Based on the Final EIR and the entire record
before the City, the City Council finds that incorporating the requirements of Mitigation
Measure AQ -2a into the Project would substantially lessen the severity of Impact AQ -2a,
such that this impact would be less than significant, because Mitigation Measure AQ -2a
requires all construction activities to occur in compliance with the Bay Area Air Quality
District's best management practices, which the District has determined reduce the health
risks associated with fugitive dust from construction activities to acceptable levels. This
finding is based on the entire record of proceedings for the Project, including but not limited
to the discussion and analysis set forth on pages 4.2-23 through 4.2-24 of the DEIR, which
includes a full statement of the impact and applicable mitigation measures and is hereby
incorporated herein in its entirety.
2. Air Quality Impact AQ -2b: Construction activities associated with the proposed project
would exceed the Air District's regional significance threshold for nitrous oxides (NOx).
Mitigation Measures. Mitigation Measure AQ -2b will be implemented for the
Project as provided in the MMRP.
Findings Regarding Impact AQ -2b. The City Council hereby finds
that incorporating the requirements of Mitigation Measure AQ -2b into the Project would
substantially lessen the severity of Impact AQ -2b, such that this potential impact would be
less than significant, because Mitigation Measure AQ -2b requires all construction
contractors to use construction equipment that meets or exceeds EPA Tier 4 Final
emissions standards and to take other steps to reduce emissions of nitrous oxides from
construction equipment to satisfy the Bay Area Air Quality District's regional significance
threshold for such emissions. This finding is based on the entire record of proceedings for
the Project, including but not limited to the discussion and analysis set forth on pages 4.2-
24 through 4.2-26 of the DEIR, which includes a full statement of the impact and applicable
mitigation measures and is hereby incorporated herein in its entirety.
3. Air Quality Impact AQ -3: Construction activities associated with the Project could
cumulatively contribute to the non -attainment designations of the Air Basin.
Mitigation Measures. Mitigation Measures AQ -2a and AQ -2b will be
implemented for the Project as provided in the MMRP.
Findings Regarding Impact AQ -3. The City Council hereby finds
that incorporating the requirements of Mitigation Measures AQ -2a and AQ -2b into the
Project would substantially lessen the severity of Impact AQ -3, such that this potential
impact would be less than significant, because Mitigation Measure AQ -2a requires all
construction activities to occur in compliance with the Bay Area Air Quality District's best
management practices, and Mitigation Measure AQ -2b requires all construction
contractors to use construction equipment that meets or exceeds EPA Tier 4 Final
emissions standards and to take other steps to reduce emissions of nitrous oxides from
construction equipment to satisfy the Bay Area Air Quality District's regional significance
ATTY/RESO.0052 CC RESO CEQA BROADWAY PLAZA—SOBRATO
REV: 05-15-19 PR
393
