05/20/2019 <br />RESOLUTION NO. 15768 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY ADOPTING CEQA FINDINGS OF FACT, STATEMENT OF <br />OVERRIDING CONSIDERATIONS, AND MITIGATION MONITORING <br />AND REPORTING PROGRAM; CERTIFYING THE FINAL <br />ENVIRONMENTAL IMPACT REPORT FOR THE BROADWAY PLAZA <br />PROJECT AT 1401 BROADWAY AND 2201 BAY ROAD; AND <br />APPROVING A WATER SUPPLY ASSESSMENT FOR THE PROJECT <br />WHEREAS, the Applicant, The Sobrato Organization ("Applicant'), submitted an <br />application for an Architectural Permit (AP2016-062), Planned Development Permit <br />(PD2016-005), Use Permit (UP2018-001), Vesting Tentative Map (TM2016-005) and <br />Affordable Housing Plan for Broadway Plaza, including 119 affordable residential units, <br />401 market -rate units, 420,000 square feet of office, 26,000 sq. ft. of retail, 10,000 sq. ft. <br />of childcare and 1.6 acres of publicly -accessible open space, located at 1401 Broadway <br />and 2201 Bay Road (the "Project'), which is located within the Mixed Use Corridor — <br />Gateway Broadway Zoning District (Broadway portion) and the Light Industrial Incubator <br />— Emergency Shelter Overlay (Bay Road portion); and <br />WHEREAS, the City determined that the Project required preparation of a <br />Environmental Impact Report (EIR), pursuant to the requirements of the California <br />Environmental Quality Act (Public Resources Code Section 21000 et seq.; hereafter <br />"CEQA"), and the Guidelines for Implementation of the California Environmental Quality <br />Act (Title 14, Sections 15000 et seq. of the California Code of Regulations, hereafter "CEQA <br />Guidelines"); and <br />WHEREAS, from April 7, 2017 to May 8, 2017, the City held a public review period <br />on the Notice of Preparation (NOP) for the EIR. The City mailed, published and posted on <br />its website a NOP to notify responsible agencies of the State Office of Planning and <br />Research, surrounding property owners and tenants, and interested parties that an EIR <br />would be prepared for the Project; and <br />WHEREAS, on April 18, 2017, the Planning Commission (Commission) held a <br />public Scoping Session on the EIR that served as a forum for the Commission and public <br />to comment on the NOP, to learn about the Project and discuss environmental issues that <br />should be addressed in the EIR; and <br />WHEREAS, pursuant to the requirements of the CEQA and the CEQA Guidelines, <br />the City prepared a EIR to evaluate the potential environmental impacts associated with <br />the Project; and <br />WHEREAS, the Draft EIR was published and circulated for public review and <br />comment beginning on November 8, 2018 through January 4, 2019.
