05/20/2019 <br />Findings Regarding Impact CR -5. The City Council hereby finds <br />that incorporating the requirements of Mitigation Measure CR -5 into the Project would <br />substantially lessen the severity of Impact CR -5, such that this potential impact would be <br />less than significant, because this measure requires (a) training of construction crews to <br />identify cultural resources, (b) halting all work if tribal remains or cultural resources are <br />encountered during construction, (c) specific steps be taken to protect and preserve such <br />remains or significant cultural resources, (d) notification of the Native American Heritage <br />Commission, and (e) proper treatment and disposition of any Native American remains <br />with appropriate dignity. This finding is based on the entire record of proceedings for the <br />Project, including but not limited to the discussion and analysis set forth on page 4.4-12 of <br />the DEIR, which includes a full statement of the impact and applicable mitigation measures <br />and is hereby incorporated herein in its entirety. <br />12. Geology, Soils & Seismicity Impact GS -3: Project development could cause ground <br />settlement due to dewatering. <br />Mitigation Measures. Mitigation Measure GS -3 will be implemented for the <br />Project as provided in the MMRP. <br />Findings Regarding Impact GS -3. The City Council hereby finds <br />that incorporating the requirements of Mitigation Measure GS -3 into the Project would <br />substantially lessen the severity of Impact GS -3, such that this potential impact would be <br />less than significant, because this measure requires the Project geotechnical engineer to <br />implement a settlement monitoring program to address any potential settlement problems <br />anticipated from the groundwater table drawdown and/or any observed settlement due to <br />dewatering or excavation activities. This finding is based on the entire record of <br />proceedings for the Project, including but not limited to the discussion and analysis set <br />forth on pages 4.5-11 through 4.5-12 of the DEIR, which includes a full statement of the <br />impact and applicable mitigation measures and is hereby incorporated herein in its entirety. <br />13. Noise Impact NO -1: The project would not cause exposure of persons to or generation of <br />noise levels in excess of standards established in the City's General Plan or Municipal Code, <br />or applicable standards of other agencies. However, due to the long duration of construction <br />activities, Mitigation Measure NO -1 is recommended to reduce potential noise impacts. <br />Mitigation Measures. Mitigation Measure NO -1 will be implemented for the <br />Project as provided in the MMRP. <br />Findings Regarding Impact NO -1. The City Council hereby finds <br />that incorporating the requirements of Mitigation Measure NO -1 into the Project would <br />substantially lessen the severity of Impact NO -1, such that this potential impact would be <br />less than significant, because this measure requires the Project to incorporate numerous <br />noise -reducing practices into the construction contract agreement documents to be <br />implemented by the construction contractor during the entire construction phase of the <br />project, including the requirements to: (a) prepare a Construction Noise Control Plan; (b) <br />limit the hours of construction; (c) notify all neighbors of the project site of planned <br />construction activities; (d) post signs with contact information for persons with concerns <br />ATTY/RESO.0052 CC RE50 CEQA BROADWAY PLAZA — SOBRATO RESO.
