05/20/2019 <br />available to avoid or further reduce the severity of this potentially significant cumulative <br />impact, it remains significant and unavoidable. The City Council hereby finds, however, <br />that there are specific economic, environmental, social, legal, technological and <br />other considerations that make infeasible the potential mitigation measures described in the <br />EIR to mitigate the effect of Impact NO -7, and that development of the Project will provide <br />specific economic, environmental, social, legal, technological and other benefits that will <br />outweigh the significant adverse effects of Impact NO -7, as set forth in the Statement of <br />Overriding Considerations below. This finding is based on the entire record of proceedings <br />for the Project, including but not limited to the discussion and analysis set forth on pages <br />4.10-21 through 4.10-22 of the DEIR, which includes a full statement of the impact and is <br />hereby incorporated herein in its entirety. <br />16. Transportation and Traffic Impacts TT -1 and TT -7: Implementation of the Project <br />would cause or significantly contribute to impacts at the following intersections listed in Table <br />4.13-8 on page 4.13-27 of the DEIR: Intersection 92, Intersection 44, Intersection #6, <br />Intersection #7, and Intersection #12. <br />Mitigation Measures. Mitigation Measures TT -1 A, TT -1 B, and <br />TT -1C will be implemented for the Project as provided in the MMRP. <br />Findings Regarding Impacts TT -1 and TT -7. The City Council hereby finds <br />that incorporating the requirements of Mitigation Measure TT -1B into the Project would <br />substantially lessen the severity of Impacts TT -1 and TT -7 with respect to Intersection 412, <br />such that these potential impacts would be less than significant, because this mitigation <br />measure requires the Project to install a traffic signal at Intersection #12 which will <br />maintain an acceptable level of service at this intersection. <br />The City Council further finds that incorporating the requirements of Mitigation <br />Measures TT -1A, TT -113, and TT -1C would substantially lessen the severity of Impacts <br />TT -I and TT -7 with respect to Intersections #2, #4, #6, and #7, such that these potential <br />impacts would be less than significant, because these measures require the Project to (a) <br />contribute the Project's fair share to the cost of specific improvements at Intersections #2, <br />#4, #6, and #7, and (b) make specific infrastructure improvements relating to the operation <br />of Intersection #6, and completion of all of the contemplated improvements would ensure <br />that operations at all of these intersections would remain within acceptable levels of <br />services. However, actual installation of the improvements to be funded by Mitigation <br />Measure TT -1 is within the jurisdiction of another public agency, the California <br />Department of Transportation (Caltrans), and consequently, the City cannot ensure that all <br />of the necessary improvements will be installed in a timely manner. Because the City <br />cannot guarantee the timely completion of all the improvements required by Mitigation <br />Measures TT -1A, TT -1 B, and TT -1 C, and because there are no other feasible mitigation <br />measures available to avoid or substantially lessen the severity of Impacts TT -1 and TT -7, <br />these impacts remains significant and unavoidable with respect to Intersections #2, #4, <br />#6, and #7. The City Council further finds, however, that development of the Project will <br />provide specific economic, environmental, social, legal, technological and other benefits <br />that will outweigh the significant adverse effects of Impacts TT -1 and TT -7, as set forth in <br />the Statement of Overriding Considerations below.
