6.G. - Page 1 of 13 <br />/<�ik <br />Redwood <br />CitylCallifornia <br />Faunded 1867 <br />Ago/ <br />DATE: June 10, 2019 <br />SUBJECT <br />STAFF REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />Landscape Maintenance Agreement — 900 Middlefield Road (Crossing 900 - Block 2) <br />RECOMMENDATION <br />By Motion, approve and authorize the City Manager to execute the Landscape Maintenance Agreement <br />with Redwood City Partners, LLC. <br />STRATEGIC INITIATIVE <br />Economic Development <br />BACKGROUND <br />On July 22, 2013 the City Council approved the Disposition and Development Agreement (DDA) for the <br />Block 2 development which consisted of approximately 300,000 square feet of office uses, 5,075 square <br />feet of retail/eating and drinking uses, and 904 parking spaces (the Project). The DDA, Downtown Planned <br />Community Permit and Subdivision Improvement Agreement, as implemented by the Construction <br />Permit, approved and issued by the City, required the developer to make on-site and off-site <br />improvements. Improvements included grading and drainage, paving, water, fire, sanitary sewer, storm <br />drainage, and joint trench utility services. The total amount of improvements completed was $510,400.00. <br />On July 25, 2016 the City Council accepted the construction improvements for the Project and returned <br />the bonds in accordance with the terms of the Subdivision Improvement Agreement. <br />ANALYSIS <br />At the time of the acceptance of the improvements in 2016, it was thought that the DDA signed on July <br />30, 2013 had adequate provisions for the ongoing maintenance of the Project site, including the <br />improvements generally covered by the Landscape Maintenance Agreement. However, the DDA <br />maintenance obligations expire within 10 years of the issuance of a certificate of completion for the <br />Project, which occurred on October 28, 2016.
