6.G. - Page 2 of 13 <br />a Landscape Maintenance Agreement (LMA) similar to what is in place for other projects in the downtown <br />area, and consistent with the Conditions of Approval for the Project. The maintenance obligations of the <br />LMA are designed to supplement the Property Owner's DDA maintenance obligations, and would go into <br />effect immediately and continue in perpetuity. <br />The Landscape Maintenance Agreement identifies the maintenance obligations and the maintenance area <br />as all of the frontage improvements between the building/property line and the curb and gutter, including <br />the sidewalk, driveway, landscaping, irrigation, and pedestrian street lighting. Cobra style lighting are <br />owned and maintained by the City, and the property owner does not have any obligation to maintain <br />them. <br />FISCAL IMPACT <br />There is no fiscal impact to the City as a result of this action. <br />ENVIRONMENTAL REVIEW <br />The proposed agreement is consistent with the Initial Study Checklist (IS Checklist) relied upon in <br />connection with approval of the Project on July 22, 2013.
