Program Implementation Plan in developing and installing the public art, including: <br />a) Creating and following a public process to choose public art that is acceptable to, <br />and inclusive of, the North Fair Oaks Community, <br />b) Locating the public art within the Plan's identified boundary of North Fair Oaks, <br />and, <br />c) Providing brief documentation of the process followed, proposed artwork, and <br />installation location to the City prior to implementation of the artwork. <br />10. The County shall act as lead agency for the design and preparation of plans, <br />specifications, construction administration, construction, and construction inspection for the public <br />art component of the Neighborhood Street Enhancement Program Implementation Plan located <br />in unincorporated San Mateo County. <br />11. The County agrees that upon completion, elimination, or abandonment of the <br />work specified under this Agreement and acceptance thereof by the City and the County of all <br />work contemplated by this Agreement, the County shall continue to have all ownership and <br />maintenance responsibilities for the improvements, fixtures, and furnishings constructed hereto <br />under this Agreement located within unincorporated San Mateo County. <br />12. To the full extent permitted by law, the City shall defend, indemnify and hold <br />harmless the County, its officers, agents and employees from all claims, damages, suits, or <br />actions of every name, kind, and description, arising out of or relating to the matters covered by <br />this Agreement to the extent that such claims, damages, suits or actions are due to the negligence <br />or willful misconduct of the City or the City's failure to perform obligations required of the City <br />under this Agreement. <br />13.
