SECTION 3 — UNION SECURITY <br />3.1 Employee Rights <br />The City and the Union recognize the right of employees to form, join and <br />participate in lawful activities of employee organizations and the equal, <br />alternative right of employees to refuse to form, join and participate in employee <br />organizations. Neither party shall discriminate against an employee in the <br />exercise of these alternative rights. <br />3.2 Dues Deduction <br />3.2.1 The Union may have the regular dues of its members deducted from <br />employees' paychecks under procedures prescribed by the City. Dues <br />deduction shall be made only upon certification from the Union that an <br />employee has authorized such deduction. After the initial certification <br />of dues deduction authorizations, the Union will send a list of <br />membership changes to the City, certifying that the Union possesses <br />and will maintain an authorization for dues deductions signed by the <br />individuals on the list from whose salary or wages the deductions is to <br />be made. <br />3.2.2 The City and the Union agree that such written certification is a <br />condition precedent to the City's obligation to begin a payroll <br />deduction. <br />3.2.3 Dues deduction shall continue until: (1) such certification is revoked, <br />in writing, by the Union; (2) the employee is transferred to a bargaining <br />unit represented by another employee organization; or (3) the <br />employee separates from City employment. <br />Dues deduction shall be suspended during any unpaid leave of <br />absence. <br />3.3 Hold Harmless <br />The Union shall hold the City harmless and shall fully and promptly reimburse <br />the City for any reasonable legal fees, court costs, or other litigation expenses <br />incurred in responding to or defending against any claims against the City or any <br />of its agents, or employees, in connection with the interpretation, application, <br />administration or enforcement of any section in this MOU pertaining to Union <br />Security. <br />3.4 Bulletin Boards <br />The City shall provide suitable space for bulletin boards in City fire stations. The <br />Union shall provide bulletin boards no larger than thirty inches by forty inches <br />(30" x 40"). The Union shall be allowed to use such bulletin boards for <br />
